Hello everyone! I am glad to be hare and read all this wonderful information!! Thanks for educating me!! My husband was convicted of 2nd degree manslaughter and sentenced to something like 16 years and got a second strike. He is in CAlifornia. He was recently reclassified and is a level 2 inmate now, due to good behavior. My question is: is 2nd degree manslaughter considered a violent crime? Would he eligible for this sentence reduction if it passes?? I was just wondering! Thanks for your answers in advance!:)

I am 90% sure that manslaughter is a violent felony. However, if it isn't he will not be eligible for resentencing under prop 66 because he only has 2 strikes. Only those in on third strikes will be eligible for resentencing.

so he would have to do 100% of his sentence? Cause he said that the lower his points gets the sooner he gets out, or something like that. He is getting ready to be reclassified as a level 1. I was just curious how it works. He was lucky it was only strike 2 cause he has a rap sheet 10 miles long. I am actually in no hurry for him to get out, I was just wondering how long I have till he does.

Points have no effect on time served. They are just to determine his custody level so they know what yard to put him on.

When Prop 66 passes in November not only 3rd strikers are eligible to be re-sentenced. Some people that were "enhanced" (doubled) because of either a first or second strike for something that would no longer be considered a stirkeable offence (which is just about anything in California now) they too would be eligible to be re sentenced. :thumbsup:

THEY GAVE MY SON 20YR BUT HE HAS TO DO 85% AND HE HAD 2 HALF IN CO JAIL DO THEY USE THAT TIME OR NO. ALSO THIS NEW LAW WOULD IT WORK FOR THIS GUYS DOING 85%.
