View Full Version : Article: Federal Judge Lowers sentence due to blakely hearing

US District court judge Thomas Penfield Jackson reduced the sentence of the "tractor man" from 6 years down to 16 months based on the blakely supreme court decision.

It looks like this was based not just on chapter 5 departures from the USSG, but also the chapter 2 enhancements and chapter 3 adjustments (such as role and obstruction of justice)

If this is true, than MANY of us that are indicted and awaiting sentencing in the federal court system will benefit. All those awaiting sentencing need to push your attorneys to file injunctions based on blakely and ask for new PSR's or new sentencing hearings. It looks like the judges are already acting and hopefully it will create a positive domino affect.

I see another post where a judge in utah has done the same, if ANYBODY has any additional related posts from their local newspapers and such PLEASE post them and lets get this info out and into the light. Maybe contact local news agency yourselves and let them know of this.

As others have said, this may possibly be the complete unraveling of the USSG.

My hubby called today and said there is a big article in the Wall Street Journal about fed judges throwing out the guidelines when sentencing. I haven't read it yet, on my way to try and find a copy.
