On Prisoner deaths, State law establishes uniform review process:
Sonny Scroggins deserves credit for pushing for legislative action to
provide for improved treatment of prisoners in Kansas.
Legislators this session approved of the "The Scroggins Initiative."
It requires the Kansas Bureau of Investigation to conduct a thor-ough
review of any inmate death in state, county or juvenile correctional
facilities, or the death of any person in private or out-of-state facilities.
The law mandates an investigation of deaths suspected to result from
natural causes, suicide or other means. Yet a review of the death of an
inmate who dies of old age, for example, would take less investigation than
a case involving potential abuse, neglect or official neglige nce of a
prisoner. The law also requires that the bureau report its findings to
legisla-tors and make its investigation report available to the public.
The KBI investigates about 95 percent of all inmate deaths or re-lated
deaths that occur in state prisons and county jails across the state. So the
measure merely establishes uniform procedures for that ap-proach.
The public will benefit from an outside review of all prisoner deaths.
The review process also fulfills a state obligation to ensure that the
state prisons and county jails operate within the law."
