My brother plea bargained and then the prosecuter accused my brother of things that he was not ever charged with!!! These accusations caused the judge to give my brother a longer prison sentence.
I felt that was horribly wrong at the time but his defense attorney said it was standard procedure. I wanted to sue the bitch for slander but prosecuters are immune to such actions. I am happy to see that this ruling has gone through. Now prosecuters and judges will only look at what the person is pleading guilty to. It's about time.
I believe it will take one person to challenge his sentence that was based on tactics such as these. Once a precedent is set, the prison doors will open for many. I just wish I had the funds to do this. Until I can raise the funds, I will anxiously wait for someone else to get this ball rolling.
