My husband filed for clemency on the 1st of June. The board just got his app and I was wanting to know if anyone here has gone all the way through the process and can give me an idea on a time frame. thanks!!

Our attorney told us that after the paperwork was submitted, it would take about 4/5 months after the Board received it (because of the tremendous backlog) to make a decision to turn it down or send it to the Gov. I read that it could take 6/8 months for everything to be completed. I hope this helps some. It sounds like the Gov. is granting clemencies at this time. He told me he talked to the IPO and she told him the board has to let him know something in 30 days. This is our second time to file for clemency, last time it took 4 months from start to finish. The board denied him last time but still had to send it to the Gov. That was 4 years ago and he had NO support from anyone that mattered, that is. I do know that once the Gov. gets the application he has 120 days to file a response. That came from the Govs office. I called and talked to a lady up there and thats what she said. I tell you, I hate talking to those people. They all treat you like YOU did something wrong. Like the guys behind bars should have NO support. Anyway, let me know when you hear something on your man. We are trying to get the rest ASAP (of course). His family turned their back on him and my family doesn't know about him. I am a single parent of two children and trying to make ends meet and save money for him. It's a rough road, but we'll make it. Good luck to you!!!! I hope your man comes home soon. The first time my husband filed he had an attorney and got DENIED! He just took his money. Anyway, about our stories...i met my husband while he was in prison. I am also a mother of two. Anyway, I kept my husband a secret for a very very long time. Probably about a year. Every time I would go see him I had to come up with a lie so my parents wouldnt find out. The bad part about it ismy step mom works at the ADC! His family had NOTHING to do with him either. But after 4 years and a lot of standing up his family is back in the picture and mine now accepts him. We just got married in July. My kids call him daddy and my parents went on vacations and actually brought him something back! Of course they told me not to give it to him until he came home, like im stupid or something. But it really helps to have the support of your family. In Ohio the application stated that it would take 6-8 months for a decision. Our decision came in just about 6 months. In Ohio, you can file for clemency every 2 yrs. I've just requested the copies of recommendation/report from the Parole Board in Oh. They say as a rule of thumb the 1st request is automatically denied. So, we will be re-trying in 2006. I wish you the best!! juliwaits 06-28-2004, 12:18 PM I know someone in ADC who filed for clemency, he made it past screeners and went before the board, but it took at least 2 months to get his results back from the board. they told him he'd have results sooner, but then blamed "switching computer systems" when the results didn't come back. I have been spoken to like I am worse than a convicted felon and as if I have absolutely no right to disturb "these folks" by asking a question. They meet every 3 months. We also found out they just met in June and wont meet again until September. My husband turned his app in June 1st but the B**** DIDNT send it to the baord until the 22nd. Guess what??? IT MADE IT THERE TOOOOOOOOO LATE TO GET REVIEWED FOR JUNE! So now we have to wait until September! I HATE THE PRISON SYSTEM! I suggest if anyone plans on calling the Post Prison Transfer Board they talk to her. You can reach her at 501-682-3850. She actually talked to me like I was a human and had a right to call and ask questions. Ok, now to what I was going to say. She answered a lot of my questions. The clemency board DOES meet every month. With the amount of request they have they are only vewing 200 a month. That means my husbands review has been pushed back to Sept. 4th. Thats when the board will make their reccom. and pass it on the the Gov. So I guess not all hope is gone. domsgrl 07-09-2004, 08:54 PM My husband made it all the way to the Govenor. Phase 1 approved by 5 board memebers- Phase 2 approved by 4 out of 5 members- final phase the Gov....SHE DENIES IT. I do not understand how someone who does not even sit in on one of the hearings, does not listen to any of the pro's or con's, doesn't experience any of the emotion, can make an educated decision and feel good about it. The Govenor looks over some notes and gets a briefing on what went on in those hearings and then makes the final decision. How can she justifiy her denial when 5 others recommended my husband for release. What did she miss by not being a part of the whole process? Obviously a lot if she 1 person denies what 5 other persons recommended. This process is a total waste of our tax payers money. I understand that clemency is a privledge, not a right but if this system doesnt change then why even bother. I hope the process goes better for you, than it went for us. I personally think that they are purposefully rude in an attempt that we will abandon our loved ones and then that would make fewer people for them to deal with. You have the right idea, just be as pleasnat as they are rude! It would be WONDERFUL if we heard something in November. He could behome in Jan!!!! :D Good luck with your court stuff. We have tried everything under the sun with the court system and it just plain SUCKS! This is our last hope. Its our second time to file and my husband is considered a violent offender ( yea right!) so he can only file every 4 years. He only have 36 months left at the most and in Jan. hes going to work release. Either way he will be home in April, I just hope its FREE! but either way, ill take his butt HOME even if for only a weekend. What kind of stuff do you have going on with the courts? The new news on my husbands clemency SUCKS! I called last week and was told that his application was actually up for review September 3rd. I was so excited UNTIL I called the IPO's office and they told me they didnt think he would make Septembers review due to THEY dont have all their paperwork done. We got all of our stuff done and sent in in June, why cant they have all their stuff done? They had all of June, July and August to get it. Thats 3 months. Looks like with the overcrowding they would be rushing this stuff. Guess not! By they way....I HATE MCI! They have blocked my phone more times this month than I have gotten phone calls. I dont even owe them money. I am on prepaid and only get 12 calls a month! They keep telling me if I will go with MCI as my local carrier this wont happen, I told them I HATED them and I didnt know what I would be more excited about when my husband got home, him home or me being done with THEM!:angry: Sorry, just really upset..phones blocked! I asked the IPO the other day about the 90 day thing (cause I heard the same thing...that everything was on hold for 90 days because of all the crap) and the lady I talked to told me that she hadnt heard anything like that. As far as she knew everything was still running as usual BUT they like to get our hopes up and then CRUSH us with bad news. If you do hear anything, PLEASE let me know. I am SO ready for him to come home. How is your man doing on the 309? Tell him NOT to give up. It IS better than being in prison, tell him to trust someone he doesnt even know..ME. He talked to the IPO at his unit and she told him 4 applications for clemency were turned in from his unit, all but his were denied! He told her that the board recc. a review and she said that was great! He will go up infront of the parole board and the clemency board will then make their decision. He said she told him he should go up next month. I will find out when I call Tuesday, for sure. She also told him this was something they had to do before they sent it to the Gov. she said that when they do this they have already made up their minds and are going to recc. clemency but I told him not to get his hopes up because some people there like to tell you things to get your hopes up and then slam you into that cold hard floor but I was to late. He already has his hopes up. I want to be excited too but I dont think I can take another let down. But anyway, when he goes infront of the board he can have as many people there for support that he wants, only one person can speak on his beahlf other than himself. He wants me to be the one to talk but im really nervous. What if I say the worng thing and it gets denied because of ME! I told him even though the IPO told him this is "just something they do" we could say the wrong thing and blow it out of the water. He said someone told him they may ask ME what will I do to insure that he will not return to prison? They never asked me what I was going to do to ensure my husband stays out of trouble. I dont think it's really anyone elses responsibility but his. i mean if he messes up, i'd leave him, so that gives him more incentive to behave, but i can't KEEP him out of trouble if that's what he really wants to do! crisnclay 11-17-2004, 08:45 PM I dont believe I said they asked me what I would do to make sure he stayed out of prison. The only question he asked me was why I wanted my husband home. I know in a previous post i said i thought they were going to ask me what I would do to keep him out of prison but I was not asked that question. Mr. Zeno was very nice AND stern with us. He shot us straight. He told us what could happen and even IF the board votes for clemency the Governor can still deny it. Im sorry you had a bad experience with Mr. Zeno. Everyone on the board I have talked to( Mr. Felts, Mr. Belken and Mr. Zeno) has been very nice to me and have answered my questions honestly. Mr. Zeno seems like a man you would want on your side. He told us yesterday that they are trying to do away with the 70% law beacuse it has a lot of people in prison that dont need to be there. Hes not some hard core "You do the crime YOU do ALL of your time" type person. He believes in second chances, thats someone I want on my side. I have no idea of how the board is voting (except for Mr. Zeno) and I will tell you this now, if all of them vote against this I will not hold any ill will towards them. Dont get me wrong, I will be upset but I cant put people down for treating and talking to me and my husband like humans. In my eyes Mr. Felts, Mr. Belken and Mr. Zeno are wonderful people. (We told him my husband's grandmother is dying as one reason for wanting to take stipulated classes outside. My husband has been locked up for 7 years (8 in Jan) and has already taken every class he could take. There is nothing left for him to take. When did your husband go in and when does he get out? Whats he in for? I talked to a guy the other night that applied for clemency and actually got it. I asked him how long it took, from start to finish. He said it took 11 months from the day he turned it in until the day he heard from the Governor. It was 9 months for me and Clayton on the 1st of Feb. He also told me the Governor only looks at clemency applications once a month and its usually around the 16th or 17th. I hope we hear something soon. After he finishes the program, we are planning on filing clemency! If the victim's mother goes to the Governor or PPTB and tells them she wants him released, that she thinks he has been rehabilitated, etc.. do you think that he has a better chance of getting clemency than if I just went and told them why I think he needs to be out?? And does anyone know if the Governor would sit down and talk to me and the victim's mother? I mean, without it having to be approved by the PPTB? It seems like this is such a long process. Dont get me wrong, it doesnt hurt but the Governor will make whatever decision he wants to. My husband had the support of the pros. atty, the sheriff that arrested him, the vic. AND the Sheriff of the county he WOULD have paroled out to. Not to mention all of the family support he had and the FULL support of the PPTB and the Governor denied his application. It was like a slap in the face for HIS appointed board members, that all 5 of them thought my husband deserved a second chance and he went behind them and said "welp, na he doesnt deserve this. I know all of you say he does but I think differently". It is a very long process and even though we can refile again in a year we are not going to. Its to hard. As for you personally talking to the Governor, you can forget that! HE wants our votes but will not meet with you. Hes to good for that. He has "people" for you to talk to but they will not talk to you UNTIL the application has made it to the Governors office. Well, I guess that is all I could help you with. After he finishes the program, we are planning on filing clemency! If the victim's mother goes to the Governor or PPTB and tells them she wants him released, that she thinks he has been rehabilitated, etc.. do you think that he has a better chance of getting clemency than if I just went and told them why I think he needs to be out?? And does anyone know if the Governor would sit down and talk to me and the victim's mother? I mean, without it having to be approved by the PPTB? It seems like this is such a long process.
