State Supreme Court sets Aug. 5 execution for Tuscaloosa man
In Montgomery, the Alabama Supreme Court on Monday set an Aug. 5 execution
date for James Barney Hubbard, convicted in the 1977 shooting death of a
woman in Tuscaloosa.
Hubbard, now 74, was convicted by a Tuscaloosa County jury in the Jan. 10,
1977 killing of Lillian Montgomery at her Tuscaloosa home. The victim died
of 3 gunshot wounds to the head, face and shoulder.
Hubbard, who was living with Montgomery at the time, contended she
committed suicide.
Last year a 3-judge panel of the 11th U.S. Circuit Court of Appeals denied
Hubbard's challenge to his 1982 conviction.
Hubbard contended a statement he gave to police should not have been
allowed as evidence, that the jury should not have been told about his
1957 2nd-degree murder conviction and that his court-appointed attorneys
were ineffective.
