Well HELLO to everyone :thumbsup:
I am from tennessee and awaiting sentencing in sept 10.I have plead guilty to attempting to make meth:rolleyes: .iI am wondering if anyone can tell me what my chances of getting a self surrender and a camp are? i don't have any violent charges on my record.Just misdemeanors.they are mostly poss. charges.My history points will be catorgy 3 I am hoping to get it down.Correct me if I am wrong but 6 points is a catorgy 3 right.I think my level will start off at 26 and drop to a 19-21. and my lawyer said something about a inhancement of 3 points for that stuff being in a motel room does anyone know about this?Will I most likely get that inhancement:confused: Any help will be appericated..

Yes category III is 4-6 points. I am in Minnesota and facing federal time. I have been told that it is the government's preference to do self-surrender because they avoid the transportation costs. Unless you are a threat to the public - still involved in drugs - or break the rules of your pre-trial release - I would say yes you'll be allowed to self-surrender. I wish I knew the answer to the enhancement question, but I do not. I wish you much luck and peace in the process.

Welcome to PTO BigBear. I would say that after the Blakely decision - NO JUDGE would be smart to sentence you with any enhancements as the Supreme Court just shot down enhancements where the reason for the enhancement is not included in your guilty plea. I also think if you are out on pre-release you should be able to self surrender unless you are looking at over 10 years (10 yrs is some threshold)

First - Welcome (a little belated, but welcome none the less).
Most, if not all, of your answers have already been answered so I want try to trump in on anyone. All of the answer were on the money. The only thing that I would add is that I feel that you should have a very good shot at being allowed to self-surrender. You are out on some form of bond now, and as long as you abide by your conditions the odds are in your favor when it comes time to being sentenced. Just make sure that your attorney makes a formal request to the judge that you be allowed to self-surrender.
As for the enhancement issue - right now no one knows what to do. While the supreme court has not ruled on the federal sentencing guidelines specifically, they are all intertwined. I would expect that the court (or someone) will be clarifying this in the very near future. Until then, I would have your attorney argue against any enhancement that you did not previous agree to in your plea agreement. Again, the odds are in your favor.
