I have the same questions. I am married to a US inmate but live in the UK. He is on DR but reversed and remanded at present - another hearing due and hopefully new trial. The man is innocent and am not just saying that because he's my husband. But we want to be together, or as best we can. My employers are wiling to help effect a transfer as we have been bought out by US company - the US people have said they would be willing to take me on board. We have the INS forms here - but considering that he's on DR am doubting whether theyll even countenance it. I know you need a sponsor and he is technically mine since we're married - but the fact is have always financially supported myself and my son anyway. We were married this year - weve known each other over two years. Not long I suppose -but people on the outside meet and get married in less time. Has anybody on PTO married a US prisoner and been granted entrance under these circumstances? Any information or advice would be greatly appreciated.

If your jkob is willing to transfer you, I would definately take advantage of it and come on a work visa. You can apply for residency while you are her. Since your hubby is in prison he cannot be your sponsor. It has nothing to do with him being on DR. A sponsor must be able to show that they are able to be responsible for the person financially. It doesn't mean that you must be a millionaire,lol. Just that you are able to let the person live with you and provide them with their basic needs if necessary (ffod, housing, clothes etc.) I so believe that anyone would be granted entrance through their incarcerated loved one, regardless of sentence. Please look into transfering with you job...I think it is your best bet! Let me know if I can answer any other ?'s

Thanks Bella. I appreciate that advice. It's just a daunting thought because it's not just me - I have an eight-year old son so I have to get it right and take no chances. Do i get a green card if I apply for a work visa and when do i apply for it - before i leave or when am over. All advice would be greatly appreciated. Thanks again.

If you asked this question a few years ago your husband would not have had a chance because the INS (Title 8 USC) had total control over the individual. Today there is a lot more hope for the federal courts now have a say in all of these matters. Warning. Stay away from forms. Although they make life easier for the petitioner they are also a "Catch 22."
In your brief paragraph it appears that you neglected to post your husband's "rap sheert" (past criminal offences). If this was posted we would be able to make a determination here for you. I'm unsure what you are referring to that the INS had all control over the individual? Her husband is a US citizen...
His rap sheet will have no bearing on her admittance with him as her sponsor, aas he is not eligivle to sponsor her. You must prove employment and financial stability to sponsor someone.

I'm usure about the green card question. If your job transfers you they will do all they should handle all the paper work for you. Your son should be included in that paper work, as he is your dependant. You will receive a green card that will be valid for the length of your work visa.
