My Son was sentenced to 22Yrs, first time offender on 2 counts of felonious assault, l agg. rob, theft. This is an outrageous amount of time, considering the victims to survived and was not left permanently disabled. Thank God for that!!! I am well aware that my son will have to serve time for the crime committed, but he is only 19yrs old and will not leave the penal system until he is 41yrs old. My parental rights have now been turned over to Ross Correctional Institution, never imagined that I would have to one day see him in this situation, and so much is out of my control. My concern is I might not be alive when he is released and so I am trying everything I can based on Ohio laws to look to the court system for a reduction in his sentence.

In Ohio Post Conviction Release appeared to be the only way to go, but would not be beneficial in this case since this was a plea agreement.

My son has been doing his own research and has brought to my attention that as a first offender in Ohio with an aggravated felony, he could pursue Chapter 2929.41 filing a motion to reduce sentence, since this was his first offense and respectfully request the court to run his sentences concurrent rather than consecutive, which is why his sentence is so long. If anyone knows any information about this law, or someone that has filed under this law please let me know. Any information will be welcomed.
