77(R) HB1649 is how my husband received his credit. This is a new law and quite a few errors have been made with many inmates receiving their proper credit. There are three sets of criteria the inmate has to meet to be eligible for this credit. It mainly has to do with parolees being revoked and sent back to TDC.
Criteria.........
1) The issuance of the warrant or summons that initiates the revokation process had to have been on or after September 1, 2001.
2) Is the type of offender and I am looking for the list my husband received from State Council of Offenders. In his case, his charge was possession of a controlled substance not in a safety zone, ie school zone.
3)This is the confusing one. It has to do with the time he was out on parole. From his release date to the date of the warrant or summons that initiated the revokation process, that time has to be more than the time he owed on parole.
Here is our example.........
Release Date 2/12/99
Discharge Date (from parole) 6/2/2003
Blue Warrant Date 9/14/02
So........he was out on parole for more than 50% of what he owed on parole.
It got confusing because everytime I talked to someone at TDCJ I got a different interpretation of the law. They have no idea what they are talking about. I wanted to have the full understanding and know we were right before I started to "bitch". So I called Legislative Council in Austin and talked to the author of the Bill and got the correct version.
