:thumbsup: :thumbsup: :yay: I CAN'T CATCH MY BREATH!!!!! EVERYONE MUST READ THIS!!!!! I have been a member of prison talk for about 2 months now since my baby had his parole violated. In February 2004, he was arrested and charged with 11379 Transportation of a dangerous drug. He was held at county level until the end of February when the courts offered him Prop 36. He qualified for the Prop because the Judge, district attorney and his public defender considered his offense transportation for personal use. Although he was given Prop 36 at the county level, his parole officer violated his parole and he was sent back to Chino Institute For Men. He has been sitting in the East Facility since the end of February, went to a Board hearing in which I provided the county court transcripts that reflected his release into the Prop 36 program. After the board hearing we both thought there was no hope because although the Commissioner had the transcripts in front of her, she still violated his parole and sentenced him to 10 months. No Prop 36. He was supposed to go back to court (county) the beginning of April to show the judge his progress in the program, but since he was violated, he was unable to appear at the scheduled hearing. Thus a warrant was issued at the county level. Unwilling to accept all of this and knowing what injustice was occuring I was determined to get some answers. You see when he was paroled from his controlling case in 2002, at the top of his parole paperwork it stated he was Prop 36 eligible, since then he has done nothing to change this eligibility, nor has he ever been convicted of a drug charge in his past. After sending several emails to the Prop 36 Coordinator for the Department of Corrections which explained my baby's situation and questioned the injustice that had been commited by the Commissioner of the BPT, his Parole officer, not to mention my desire to know why he couldn't benefit from Prop 36 (a program the citizens of California voted for and he was clearly a qualifying candidate for) I received the greatest Mother's Day present I could possibly ask for when I checked my email today. The Prop 36 Coordinator sent me an email that stated simply, "per a decision yesterday by the Board of Prison Terms, he is being released with instructions to complete a proposition 36 treatment program." After reading this email and catching my breath, all I could do was thank the good Lord above. My baby is coming home. I did it!!!!! We won!!! It is my understanding that he will now be taken back to county to clear the warrant and then be released to come home. I know that it doesn't take long for them to be shipped to prison, but does anyone have any idea what the procedure is if they are going back to County. I really need to know. Also, if anyone out there from around the Hemet area is going to Chino tomorrow for visitation, I am in desperate need of getting there myself. Anyone willing to CARPOOL???? I am still in utter disbelief, I don't even know if he has been notified yet of any of this. Yes, we beat the Board. :D :dance: :haha: :thumbsup: Can you even believe it? Is this all a dream?
