Hi All, I have a qestion? my boyfriend is serving 2 yrs for 5 dui's, they sentenced him for the 4th offence, he wass in jail a few months, then of course there was the 5th. sentenced 2 yrs for that one. i thought they would sentenced one sentence for the 5, not seperately, we thought the time did for the 4th, would be subtracted from the 5th. does anyone know what i am talking about, i may not be explaing it as easy as it could be explained, but any info on this would be appreciated......still hanging in there. I know exactly what you're saying...although I'm not an expert, it sounds like they're two different charges so there would be two different sentences. From what I understand, if there's more than one charge, then the other offense(s) would be served consecutively upon completion of the first...etc.
There's a bunch of people here who know quite a bit more than I do, they'll be able to shed more light on it for you :)

In california you would be "Priored" for "ALL 4 D.U.I.s and
including the 5th!!! that is why the sentence was dramatically
increased from the 4th to the 5th! And too, they probably
gave him a "Deal for the 4 DUIs" but, gave him the "Maxs"
for the 5th!!! Hope this helps explain it .
