He doesn't. Why would he accept POA for somebody else? He's in prison. He can't make informed decisions, deal with banks, attend to property, preserve an estate, while in prison. Most prisoners are incapacitated by their imprisonment and give POA to somebody else. The person seeking to make an inmate POA should find somebody physically competent to act for him/her.

you misunderstood. the poa is for the relative on the outside to handle the inmates affairs such as they are'

In that case all he needs to do is complete a power of attorney form and have it notarized at the prison. They should be able to help him get the form and get it notarized in the law library.

Also another option, most VA prisons have attorneys visiting once a month or so in order to help inmates. He/she does not do any of the paperwork but will give the proper forms and direct one in the right direction.

I have a similar question regarding POA; I am the sibling (living in Virginia) of a California inmate who is my brother. The question is three fold:

First, do I need a Virginia POA or CA POA? Second, the reason for this question is due to the fact that he has money automatically credited into his Chase checking account monthly from the VA (Veteran's Affairs) and he is asking me for money. Will they continue to credit this account considering the fact that he is incarcerated making the POA issue moot? And third, depending on the first two answers; it is very likely he may not be out again and die in prison. With this said, is it necessary for me to have a POA for somebody that doesn't have anything in order to handle final affairs as far as cremation, etc.? He has been a heroin addict most of my life and I'm almost 55, he is my older brother and we are each other's only living relative. I'm assuming I will be contacted when this time comes because I always seem to be contacted by somebody each time he get into trouble so he's got my information somewhere at hand. Do I really need POA for a person that has nothing?

If I am not mistaken, the POA becomes invalid upon the death of the person who created the POA. I think if you are next of kin, you would be the one who would be responsible for his final arrangements. Generally, any property or money after death would not be handled with a POA but in a Will. I am not sure about the POA for the money, so hopefully someone will answer that for you.
