:ha: My fiance was on probation and his PO violated him on stupid stuff like usual and he had 3 years and 7 months left of his probation for minor offences (like traffic stuff and simple battery charge and an attempting to obtain CDS) anyway his probation officer talked him into signing a 2 year wavier. What exactally is this and what is he looking at doing as far as time? Any help you all can give me is greatly appreciated. I know what wavier means but what exactally was he waving? Does this mean he is not eligable for early release or parole? I have no clue? He is in Floyd County and waiting to go to Jackson. I have been in contact with the parole board via email (thanks to you wonderful people) and they said that as soon as he is sent to diagnostics they will consider his case. Does this sound good or is it the usual? Please help me I have no idea what i am doing....thanks a million!:ha:

Usually a waiver is involved when there is a guilty plea made by the defendant. Exactly what is stated in the waiver is dependent on the individual case and sentencing. Waivers can be used to ensure a certain period of time is served by the inmate, as well as to take away rights after sentencing, ie: a parole waiver.
If I was you I would find out more about what his waiver states before getting worried. It could merely mean that he is not allowed to plea not guilty, etc. and that he has to openly accept his revokation of probation. Sounds like a 2 year waiver means he may not be eligible for release until after the 2 years has been served.
