My guy was denied Parole! I am in a state of shock. He's going to appeal it..anybody know anything about this? I'm calling a lawyer today, once I stop crying, of course.
Damn. Now he's got another year. I can't believe it.

Oh my god! I am so sorry. Did they give a reason? I really don't know much about the whole parole thing. But I will keep you and your guy in my thoughts and prayers. I hope things work out for you. Good luck.

How do you appeal after being denied parole? I didn't know you could do that.

first he does an adminstrative appeal, have him contact his counselor immediately, then if that does not work he will need to do an article 78. What board was this for him and what reason was given for denial.

I really didn't know you could do an appeal because my husband was denied parole in January but it's all good because he will be release in September 2004 which is this year.

From what I know about parole if you get denied and they only give you another year, that is a good thing. The usual is 2 years. Is his sentence up in a year? I was told that if you get 12 months at the parole board that means you are going home next year. If you get 2 years, well they can play that game forever or untill you hit your CR date. I was crushed by the parole before and it won't happen again. I just figure no one gets parole, of course I'm talking about violent offenders here. You only have a certain amount of time to appeal and it just depends on the reason for the denial whether it will work or not.

His crime was identity theft, and I think because that's such a big deal now, they were being extra hard. (his was not a computer crime, though). He got 1-3, so he will get out on his conditional release date 5/05. The reason they gave was that he has a "lengthy criminal history." He's had prior arrests for misdemeanors, but this was his first and only conviction. I checked out a little on line, and apparently only 3% of appeals get overturned, but you gotta try, right???

I am very sorry about your news. I know there is a way to appeal, I think it's called a 728 or something like that, I am not sure at all but , of course, a lawyer is your best bet. And knowing hte reasons they denied will also be of great importance so I hope you can document them soon.

I'm sorry to hear about your bf. My husband was also denied parole back in February so I feel what your going through. Were going to ride this one out until next year. Best of luck to you..

im so sorry...I dont know how a lwayer will make a difference though. He can appeal it without one, but to be honest I heard it takes like up to a year for that to happen...
did they say why he was, was this his first? how much longer? how do you know it is a year? they usually hit with TWO more...
I am so scared myself, I have been through this once before and it hurts. we go back in a few days

well my husbands CR date is 2006
this is his 2nd parole and he is a violent offender so I am thiinking, he is getting denied this time too, the last time he went, they said "the seriousness of the crime" and the bad "message to the public" crap!!
oh, dont get me disouraged...who knows what the parole board will do with any of them!!

Only 3% of the people make it on an appeal that is slim to none. I asked my husband why didn't he appeal , he said what for. I guess he knew would never be one of the 3% but it's all good because he will be getting out in september of this year. I think if people has been on their best behavior, did everything their counselor told them to do, finish all their programs and hasn't gotten any tickets should be given parole. I know I was very heartbroken when my husband was denied parole I just wanted to cry. I guess they though 3 years wasn't long enough for him but he'll be home september.

Mrs. G. He is serving 1-3, and he was told they have to let him out on his CR date 5/05, unless he commits another crime.

He is also eligible for work release, and has already applied, but I am not optimistic.
