I need some assistance trying to figure out when my boyfriend will be moved to a halfway house. He was sentenced to 28 months with a release date on 2/5/05. I realize that it is limited to the last 10%, but my math isn't so hot. Will that place him at a halfway house around Thanksgiving? Also, what could I do/research to assist him in preparation of this event. Thanks!!!

Now without all of the necessary facts, this is only an approximation........
If my calculations are close, the first date that he would be eligible to be released to a halfway house would be 11/24/04. That would be the day before Thanksgiving.

The date that his sentence began and jail credit.

He was in custody since 5/12/03 and sentenced on 11/25/03. Hope that helps. Thanks Sheryl. I look forward to spending many holidays with him, and reminding him of how lucky he is to have me. LOL. Seriously, does anyone know whether or not it would be a benefit for him to have employment lined up before his transfer to a halfway house? Thanks!

Having employment "lined up" ahead of CCC transfer is never a bad idea whenever possible. That way, at least level 5 comes that much earlier.

Simple: There are 5 (programming) levels at a CCC for prerelease inmates. Level 5 is the highest (and last). It is achieved once you have a job, get paid, give the CCC their 25% subsistence payment and get weekend passes.

Do you need to pay the 25% even if after u make it to home confiment? What happens if u do not a job ready do the inmate still have to pay the 25%? How fast can an inmate get home confinment? Do you have to do CCC in the state where u do your time or can u be placed in your home area? Hope I didn't confuse you!

You will do your halfway house time in the district in which you were sentenced and not the stae that you are incarcerated in.
You still have to pay the 25% even if you are on home confinement. hkieffer is correct, there are 5 levels in the halfway house. I went in as a level three. Level one and 2 are for violaters and what they call Public Law. It takes a few weks after you find a job to go on home confinement. Level 5 is where you need to be in order to go on home confinement. Remember, home confinement is just that. You will be confined to your home exept to go to work and the 6 hours of "free time" that you are allowed per week.

There is no requirement to pay subsistence before you get a job. As long as you are actively seeking employment, you're fine. However, until you get employment, get paid and pay the 25% - you won't get weekend passes.
