OK can someone please translate this into English for me...lol .... Iam trying to figure out how much time Stephen will have to serve on his 8 year sentence before he comes up for Parole but I just couldn't get this to stick in my brain..DUH!!??! can anyone else?


All other 1st, 2nd, and 3rd degree felony offenses (a court may reduce the punishment of a 3rd degree felony by imposing the confinement of a Class A Misdemeanor)
The length of a sentence can be affected by the enhancement law (Sec. 12.42 of the Penal Code, Habitual & Repeat Offenders)
Calendar Time + Good Time = 1/4, including work credits and bonus
Maximum of 15 yrs.

Amelia........if you call the automated service for inmates they should be able to tell you his parole eligibility date as well as his projected release date if not eligible for parole. Can't remember the 800 number, but call 512-406-5200 and number 2 is for questions about inmates. The past two days they have been having problems with the automated service, but the switchboard operator can pull him up on the computer and tell you what you need to know.

DOESNT IT CHANGE WITHIN THE STATE THOUGH. I KNOW HERE IN WASHINGTON THEY TAKE 1/3 OFF FOR GOOD BEHAVIOR AND THEN ONCE YOU GET TO WORK RELEASE THEY TAKE UP TO ANOTHER 10 DAYS. SO I DONT KNOW. I WISH I COULD HELP YOU ............ SORRY!

He can request what is called a "time sheet" from the unit classification office that will show his current parole eligibility date and all other information pertaining to his time, such as mandatory supervision date (if any) and sentence discharged date (long way). The basic formula is when actual time served + good time accrued equals 1/4 of his sentence he is eligible to parole consideration. BUT, the amount of good time given changes with custody status (Line Class or State Approved Trusty). It is also effected by the date of offense and type of offense.

As you can see it's a pretty much individual thing. The person can request a time sheet every 6 months (unless they changed it) and I always made sure I requested mine just so I could make sure the information in the system was correct.

I do not know how Texas Operates, but here in North Carolina when Parole was possible, The inmate could come up for Parole after 10 % of his sentence was served. He was sentenced in 1991. He came up for Parole in 1995 for the first time. He has been looked at each and every year since then... So, I am sure Texas is different. Remember, he was sentenced to 50 years.

Amelia--tell Stephen to put an I-60 in requesting his time sheet...I think they can give it to him when he requests it...but it is standard that they get them every 6 months. That is your best bet at figuring it out...plus, it may change with time..like if he moves up in line class...or gets a major case.

He hasn't been foramlly charged yet, that is why i have been looking at all this. on Nov. 1st we are finishing up with court (hopefully) but our lawyer says with the recommended 8 year sentence he will have to do about 2-2 1/2. so I was curious because he already has almost a year behind him. I guess I was a little impatient ..hee hee...I just didnt want to have any wrong info on how long he will be there and then find out something different later on, after he is already servig it....Ralph thanks for your info and putting all that in English!!

Amelia-girl you know not to trust lawyers don't ya?? :) Just be ready for anything. I know it is hard, but dont focus too much on the closest possible date for Stephen to come home. It is better to be prepared for the latest possible date they can possibly hold him. This is Texas...once they have em' behind those fences..they don't like to let them go! Just be patient and keep the faith!!

montysgirl.......i agree with you on that!! i always say.....hope for the best, expect the worse. as many times as my husband has been in, he only made parole once and that was the first time........back in '94. everything else has been serve alls. i always use the projected release date as a marker. because (unless he gets in trouble) they can't hold him any longer than that. as far as the time on that, i can't help you. my husband is under the old law. it's a funny thing actually.........the day he had the blue warrant out for his arrest from his parole officer is the day he became eligible for parole because of the amount of flat time he has served on his sentence. if ya have any questions or if you ever need anything, please don't hesitate to ask.
