Heres a good example over our petty justice system. What about the kids that are truly getting abused. This is ridicolous, and I am glad this man got a public apology.
I commend Chief Justice Terrence Higgins for stating the facts that he did in this case.
ACT Chief Justice Terrence Higgins has apologised to a man found not guilty of assaulting his son after he slapped the boy on the leg.
Chief Justice Higgins suggested the man should never have been charged in the first place.
The incident came to light in May last year, when a bruise was noticed on the boy's leg at school.
The matter was referred to Family Services under mandatory reporting provisions and the boy was examined by a doctor.
His 29-year-old father was then charged.
But today a jury of nine women and three men found the man not guilty of assaulting his son.
Chief Justice Higgins told the man he was very sorry for the way his family had been inconvenienced and said in his view, the man should never have been charged.
