View Full Version : Federal 1/2 house & home confinement?
JamieBC 03-05-2004, 12:28 PM I have a year and a day sentence. Would I be able to do 6 months in a 1/2 house? I thought I read somewhere that you can only do either 6 months or 10% of the last part of your sentence in a halfway house (whichever is less). So, does that mean I would only be allowed to do my last month in a 1/2 house??
At this time, you would only be allowed the month in a halfway house.

what about for an 18 month sentence? How much time can he spend in 1/2 house or house arrest? I have been told quite a few different things.

kintml2u 03-08-2004, 05:20 PM I want to think it would only be about a month and a half for an 18 month sentence. I figure it after taking off the 15% GTC allowed....I could be WAY off! lol
Maybe someone like greyghost...or someone familiar with the calculations will be around to offer a better more probable answer...

My husbands original plea agreement was for 18-24 months in prison..If he had received the 18 mos, his halfway house would have been for 10% of that sentence. In our case, the judge downward departed and gave him 12 mos and 1 day in a prison camp and 6 mos of home confinement. His halfway house was then for 31 days, since he had a job and a home to go to he served 12 days in the halfway house and was sent home last Wednesday night to serve the rest of the halfway house at home. He still has to pay for the halfway house til the end of the 31 days. He then will be on home confinement with a home detection monitor for the next 6 mos.
The final sentence is up to the judge, no matter what the plea agreement is.

>> You will actually serve a total of 10 months and 13 days in BOP custody.
>> You will be eligible for a total of 47 days of good conduct time.
>> You will be eligible for a total of 31 days for halfway house placement.
The 31 days for halfway house is the max that you will be eligible for (give or take a day - depending on when you start your sentence). If anyone is telling you different than that, then they are mistaken. As jft stated, John Ashcroft made it very clear to the BOP that they are to make NO exceptions to the 6 month/10% rule.

There was 2 of my associates and myself involved in a conspiracy crime and 1 of them received a sentence of 6 mos camp and 6 mos home confinement. the other received 16 months and I got 22 out of a 18-24 month sentencing range. I would like to know how the judge was able to give her such a deal and seemingly gave me such a harsh sentence?
It could be a number of factors...your psi report, level of cooperation, if the feds thought you had more to do with it than the others...with them you never know.
hkieffer 03-10-2004, 09:31 PM Several Judges (all over the country) have held the Bureau's 10% CCC practice to be unlawful. Unfortunately, these decisions only are applicable to those inmates involved in that specific litigation.
Holly6005 03-11-2004, 02:59 AM I see some people say 10% no exceptions, then I see where people are saying that judges are changing it? Are there any people on this web site that have actually been released from a federal prison or halfway house LATELY? If so, then how much time was served in each? I think I will start a new thread for actual imates to reply to answer this question. I know Ashcroft changed it in December 2002, but from what I understand his intent was to stop the BOP from sending people directly to a halfway house INSTEAD of prison, and not change the 6 months or 10% date...Boy, I am so confused????
Basically, it is 10% no exceptions, from what i understand the only others who are getting more halfway house time is those that are challenging it..which is pretty much what howard said.
