View Full Version : Made progress!!!!
Shortie 04-03-2002, 08:34 PM Hey guess what with a lot of work and phone calls I got anthony's other detainer taken off the system.. He already appeared on the warrent and it was still in the system at TDCJ. Well I got on the good side of the supervisor Tina at the judges office where he was seen and she make a few calls and got it all cleared up.. He is going to be so excited that I got it taken care of. It is things like this that make me feel like I am doing what I am suppost to be doing for my husband. Damn I'm Good. Not I am just playin but I did get the warrent taken care of.. YEAH!!! :) :)
Amelia 04-03-2002, 08:50 PM OK shortie--bare with me but what do you mean that you got a detainer off the system?? Can a warrant be removed after they are in prison or what?? I am confused..remember I am new to all this:D
Shortie 04-03-2002, 09:03 PM what happened is that he appeared on the warrent already and someone did not remove it from the system. But TDCJ is not going to find that out.. They do not care. Since I knew it was something he already took care of I knew they had to at least try.. No normally a warrent is not taken off the system.. Unless they apprear and take care of it.. Even then they can keep a hold on you so that you can deal with them when you get out. In this case he had a PV and got sentanced to 4 yrs revoked probation. Which he is currently serving concerrently with his other charge. They can deterimine to run them concurrent (all together) or consecutive (finish one and start the other). In anthony's case it is concurrent so there was no need for the hold.. I had to do some major foot work to get it taken care of but you see who got it there way.. We did !!!
jdswifey02 04-03-2002, 09:21 PM Shortie....
Good job girl!! You are awesome!! I know Anthony will be VERY pleased.... :)
It is good to hear when something actually gets accomplished for our loved ones... :)
soraya 04-04-2002, 06:37 AM good job Shortie!!! kicking some asses can help, huh?
Goody's Girl 04-04-2002, 07:45 PM Since you did such a good job on your man's stuff, maybe you can tell me where to turn to help my husband.
When he was sentenced to 15 years and then 10 years probation, the judge gave him credit for "time served". I assume this is the time he spent in county jail prior to being sent to prison. However, this "time served" is not showing up or being reflected on his release date. Who do I turn to for help on this???
Tracy
Shortie 04-04-2002, 08:54 PM You need to contact the sentancing judge and get the documentation that shows he will get the time served.. Then contact the classification officer. That what they are called in texas.. It may be the warden's office there in fl.. Then as for a time calculation sheet and figure out where the error is.. They can imput the days he is missing but you have to prove that they are indeed missing..
If that does not work you need to go to the warden with the problem.. Then if he does nothing let me know and I will help you some more.. It is a baby step process but it can be done..
If they try to give you shi_ about the court records just go to the court house and get them from the clerk there is small fee per page but it is worth it.. So make sure you make a copy for yourself and one for the prison.. Be strong but do not have an attitude.. It will get you far when dealing with the DOC...
If you need help let me know ok
Shortie 04-07-2002, 08:36 PM they are moving anthony for court on friday, he will go on tuesday the 16th I feel so much better knowing that I can be there and I am sure that he feels the same way.. Shortie 04-11-2002, 08:14 PM Alright well I will just walk it right over. LOL You now that it is nice to laugh again.
Shortie 04-11-2002, 08:15 PM Thanks michelle.. More positive stuff yeah
Amelia 04-11-2002, 10:56 PM Anthony is very lucky to have you in his corner!! I know if I ever get in ANY kind of trouble I am calling you first!!
Shortie 04-12-2002, 07:14 PM OK I am notorious for getting out of trouble, I call it good cop karma so that is a blessing.. I have always been like that and have dealt with enough law enforcement I can ususally tell when they are full of it.. I just do not accept it and try to do something about it. I guess that is why I have gotten good at doing law research and stuff.
bella 04-12-2002, 10:37 PM Hey we should get together. I'm notorious for scheming to find out info. Ask Jd'swifey. I use anything I can to find out whatever I need to know. I think between me and you we can take care of some interesting things, lol
Michelle
jdswifey02 04-13-2002, 11:08 AM I can attest to Bella's scheming!! Gosh... I know who I will be coming to for ideas during my next dilemma (cause you know with DOC there is always going to be another dilemma...) :) With y'all in my corner, I can't lose!!! :)
Shortie 04-13-2002, 01:10 PM Alright bella it is a deal.. We will team up with luck and skill how can we go wrong.. Hey I am studing criminal justice, maybe I should be a criminal defense attorney... What cha think.. then you can do the investagations and I will prove the theroy!!! :)
bella 04-14-2002, 10:18 AM sounds good. I am a social worker, once I get my license I can also tesify as a therapist. With you as the defense attorney and me on the stand we could definately win a few, lol.
soraya 04-14-2002, 01:36 PM sounds like a really strong team!!
Shortie 04-14-2002, 04:59 PM sounds good to me.. Let's try to get on the states for the detriment they cause to the children of inmates.. They could make the visiting a little more kid friendly in most places.
bella 04-15-2002, 09:55 AM I agree lets come up with a plan
Shortie 04-15-2002, 07:25 PM ok i think we need to have a forum for people to post there problems and then we can be like dear abby but really do some help. What do you think???
Daveswife 04-15-2002, 08:11 PM You think you could make a trip to Va., David could really use you. LOL Great job and congrats!
sherri13 04-15-2002, 09:17 PM OKAY, SINCE YOU GUYS SEEM TO KNOW HOW TO MAKE THINGS HAPPEN-ANY ADVICE ON HOW TO GET A CONSECUTIVE SENTENCE CHANGED TO CONCURRENT?
Shortie 04-16-2002, 03:33 PM i have to file a motion with the judge who sentanced him and request them to be concurrent. some times they will not do it and then some judges will do it.. It depends on the state laws. I would call the attorney who handled the cases and see why they were ran consecutive and then go from there.
sherri13 04-16-2002, 06:17 PM the attorney was a public defender who probably got his law degree at k-mart. dont think i'd get much help there. what about following up with the judge?
bella 04-16-2002, 07:01 PM there are specific attorney's who handle post conviction relief. I don't know what the statue of limitations is in NC but it's 2 years in Fl. If possible try contacting an attorney for some help.
Shortie 04-16-2002, 07:13 PM Yeah following up with an attorney is a good idea, you are right going back to the public defenders office is not going to really help you.
