My son is a P O W. he was 22 years old when he was arrested, and based on a juvenile charge, then a violation of juvenile probation - with subsequent adult charges applied for both - he got a MM of 188 months. The prosecutor went after "career offender" status based on the guidelines. The tough part about my POW is that his lawyer talked him into a plea bargain to avoid the promise of "burying him in prison" made by the US Attorney. So, he got a mandatory minimum of 188 months, thank you very much to the sentencing guidelines. As soon as he got sentenced, (literally within days) his lawyer filed a motion asking for his release from the case since our son had no money. The magistrate denied the petition and ordered him to represent our son on appeal. The "appeal" turned out to be an Ander's brief, which was immediately accepted by the 11th circuit court. This past year our son filed a motion to strike the Ander's brief, which of course was denied. His next chance is to file a 2255, or petition for a re-visit based on the juvenile convictions that enhanced his sentence level (doubled it actually). So, here we are...mother and father, no money - we sold the house to pay this horrible lawyer who just turned his back on decency and defendant rights to just take the money. I'm hearing that more and more often ...where the lawyer for the defendant talks the defendant into a plea agreement to avoid extremely harsh sentences, and the defendant gets the harshest sentence anyway - when the federal prosecutor will wriggle out of the plea agreement using legal jargon and quoting federal statutes. It's really a vicious circle. I hope all of you read the sentencing blogs like Professor Berman's blog. I hope you visit the november coalition and FAMM websites. They're a great source of information, and at times - almost reassuring (to me at least). Best of luck to all of you, I just wanted to add my story and thank you for your website. That is one of the best websites I have ever visited relative to drugs. I found it years ago and visit it from time to time!
