SAN FRANCISCO (AP) - California prisoners have a constitutional right to be released on parole if they meet state
requirements, a federal appeals court ruled Wednesday.

A three-member panel of the 9th U.S. Circuit Court
of Appeals unanimously decided that convicted murderer Carl
McQuillion, 53, should be released from state prison. McQuillion killed two Long Beach residents in 1973 and was sentenced to life behind bars.

State parole officers presented no evidence to
justify revoking McQuillion's 1994 parole date six months before he was scheduled to be released, the San Francisco-based court found.

McQuillion had unsuccessfully appealed the revocation up to the California Supreme Court. Monica Knox, a deputy federal public defender representing McQuillion, said the effect on the parole system likely won't be dramatic, but the ruling would remove one obstacle prosecutors use to keep inmates from being released.

A state parole board originally decided to grant McQuillion parole in 1977 after determining he no longer was a public threat. He received the 1994 release date based on his conduct in prison.

McQuillion has formed organizations to help new inmates adjust and helped inmates with legal questions. Knox has said her client plans to work with other convicts to help them adjust to life after prison when he is released.

McQuillion and an accomplice killed the owners, a father and son, of a sporting goods store in Long Beach on Dec. 26, 1970.
