Prisoner Wins Media Access Battle

A life sentence prisoner who was denied access to telephones to contact the media has today won a High Court case in which he challenged the Prison Service under the Human Rights Act.

John Hirst, General Secretary of the Association of Prisoners, and who is serving a life sentence at Sudbury Prison in Derbyshire, was at Rye Hill prison in Warwickshire when he was disciplined for contacting a radio programme. Hirst, who has taken several law qualifications whilst in prison, sought Judicial Review of the decision.

The High Court this morning ruled that the decision was unlawful, but did not go so far as to allow all prisoners unrestricted access to the media. A spokesman for the Association of Prisoners said today:

"We welcome this ruling. Our prison population is more than seventy thousand, and public awareness and scrutiny is essential to the penal system. Allowing prisoners to speak out allows tax-payers to be fully aware of the state of the prisons that they are paying dearly for."

The High Court granted the Home Secretary leave to appeal against the decision, but it is expected that the Prison Service will now revise policy in this area.
