Mrsdragon posted a thread a while back wanting to know if anyone has been married in a Canadian Prison. Now I have been asked about how a Canadian goes about getting married to a US inmate. If anyone has been married to a inmate that is in prison here then I would love to hear about what kind of process you had to go through.

So far the only kind of information I have is limited. I know that we have had a couple members from Europe marry a US inmate. I would guess that some of the international process is the same then once that is taken care of then the prison marriage policy for that state would apply. Here is a link that has only one persons experience and I contacted others in hopes that they could add to this. As far as can an inmate move to another country after having a felony here. That is a good question and I will try to get an answer

tebkrg 02-17-2004, 09:04 PM There are some threads kicking around somewhere and I will try to dig them up - they give more detail but the basic is: A felon cannot move to Canada until after their parole has been discharged and they MUST then apply for the right to enter the country - this is even the case to visit the country. If you are caught at the border you will just be sent back. I don't think that it is any offence to try to gain entry and it would not affect your US record even if you got across - it is a Canadian law.
In some instances marriage may help, but I don't think unless it is a Canadian in a US prison that it is going to change things that significantly.
I just wanted to let those who were interested in marriage to a US inmate know that I have found a Canadian who is about the marry an inmate. She should be getting married in the next few months so I will have more information in the wedding forum real soon. Now keep in mind that from the sounds of it if you marry a US inmate you will have limited options and choices as far as being together after he is released.
arriana 02-22-2004, 10:36 PM as a canuck we can live in the us for 6 months at a time without worry, we can then drive over the border hang out at home for a wee bit then go back. they can not sponsor us a finacee until they are working and then the immigration is normal marriage procedure. It is not that hard really but there is paperwork and patience needed. If he has a family member can sponsor you then it is even easier. They can also come to canada on a work visa by being sponsored for a job in canada . arri
I dont know a lot about immigration rules so please dont think I'm about to ask a silly question, but can a inmate sponsor you if you are married?
Hypothetical question---You are from Canada and marry a US inmate. The inmate cant live in Canada while he is on parole so you decide to move to the states. Since you are no longer a fiancee can he sponsor you or do you have to wait till he is released?

he needs an income to be able to sponsor a mate. if he has it then yes he can sponsor you. But if you are a canadian and want to go live there until he is married just do it before the 6 months period is up. You can wait for him to earn to sponsor you for the visa , do you need to have a green card or be able to work is that the trouble ?
it is a matter of to be a sponsor you need to have a financial foundation to sponsor the person you want to sponsor.

Thanks for starting this, I was just researching, and you made it a whole lot easier. I have a friend that may marry a inmate, and she has had some concerns about how she would stay in the US. I am going to send her the link to this thread, cause I think she can get alot of valueable information just from reading the posts here.

starduk 07-07-2004, 07:33 PM I'm pretty sure it's only 3 months.. you can go there for three months, then you have to come back to Canada for a period of at least 2 weeks.. then you can go back..

I am a Canadian ( from eastern ontario ) and my husband to be is in a facility in NY State. We were talking about marriage before he got locked up and we are still talking about it. We might be getting married while he is in there but from all the info I have read about immigration, I still have to come back to canada and then we start the process for a K3 visa which takes about a year, give or take a few months.
We are hoping to plan it so that he is out a couple months before my children and I would be approved (hopefully)to move to the states. He has some family that should be able to sponser us for the application. One thing that I'm hoping might be a plus is that the company that I work for up here in canada is a US company so I should be able to get a transfer down there once I get all the paper work done.
