Does anyone know the deal if they own money for court fees and fines? My husband has to pay $270 in fees and fines. I'm not paying it for him, and I know they will take it out of his commissary, but do you know how much? If he gets $50 will they take it all or only part of it until everything is paid off? I can't beleive they would make him pay anything even after giving him time.

The will take most of it. Go to the courts and get the judge to issue a civil judgement on it so that they do not take him money. That means that they will hold it. If you decided to buy a house or anything like a car that money will have to be payed first. Good luck. If you need anymore information let me know. Paula

My Husband Is In Federal Prison In Allenwood, Pa. His Total Fines Were $127,ooo.oo To The State Of N.y. And $800,000.00 To The Good Ole Gov't. He Still Has To Serve 17 Months. Luckily, We Owned Two Houses Between Us. We've Only Been Married 2 Years. But Unfortunatley, Just Because You Pay Your Fines, Doesn't Mean You Avoid Any Prison Time.

That $270 is a surcharge. The way it works, any money that comes his way either from the outside or from his job inside, he get half and the other half is applied to the surcharge. You can't send the prison the full $270 and ask them to apply it to the surcharge to get it over with. It doesn't work that way -- rules and regulation, and the rule is they take half til it's paid. Yes, you will pay it, b/c if you send him twenty bucks or drop fifty bucks at visit, you've just paid half the surcharge, and the other half goes to him. The only way you WON'T pay it is if you don't send him any money until the surcharge has been paid, which is very, very unlikely. If he earns $7.00 a week, each week $3.50 of that will go to the surcharge, and he'll live off the other $3.50 until the $270. That would run over a year -- I can't see any wife letting a year go by without sending her husband any money. Hanksmom, I don't know how the civil judgement works, like is it a law that they unilaterally enter the amount into judgement to whoever applies, or is it somethin where the judge uses his discretion to enter the amount into judgment.

no you just ask tell the judge that you can't afford it and ask him to put a civil judgement on it. We did it. No money not even the surcharge gets taken out of his commisory money. That the way it work is nassau county I really don't know about anywhere else. I just thought that it is worth a try.

Thanks everyone. This is in the Bronx, and he's hoping his mom will pay it for him. Can she just send the money to the courts?

What ever became of this??? In my opinion...just send the money, little by little or however you can, straight to his account. At least this way he'll get SOMETHING.

Nothing. I refuse to send him any money! (we're not on the best terms right now - getting divorced) As far as I know his mom hasn't sent any money either. So he still owes the money. He messed up one to many times, and I ALWAYS got him out of it, I'm not doing it this time. call me cold hearted, but I'm just tired of it. (sorry - that was a little venting)

I don't send mine a dime. I send him his toiletries and the occassion food package but money? hmm not me. I got bills to pay and a child to feed. I didn't put that man in prison.
