Has anyone's husband come home after being charged with domestic violence?
(come home to the wife...(victim)
If yes....please explain under what circumstances.
If no.....why?

I have been informed by the parole agents in California that there is a blanket policy regarding domestic violence and parolees. All parolees regardless of what the law says (they have said they don't care about what the law says) that have committed domestic violence (whether minor in nature or not) are required to attend 52 weeks of domestic violence classes and have absolutely no contact with their spouses until this has been completed. The law says that this condition is upon the request of the victim. (Of course there is a stay away order if there was great bodily injury; in my case it was not. My husband went to prison for not completing his domestic violence classes)FN2 CA Penal Code 3053.2. (a) Upon the request of the victim, or the victim's parent or legal guardian if the victim is a minor, the parole authority shall impose the following condition on the parole of a person released from prison for an offense involving threatening, stalking, sexually abusing, harassing, or violent acts in which the victim is a person specified in Section 6211 of the Family Code: Compliance with a protective order enjoining the parolee from threatening, stalking, sexually abusing, harassing, or taking further violent acts against the victim and, if appropriate, compliance with any or all of the following: (1) An order prohibiting the parolee from having personal, telephonic, electronic, media, or written contact with the victim. (2) An order prohibiting the parolee from coming within at least 100 yards of the victim or the victim's residence or workplace. (3) An order excluding the parolee from the victim's residence
Anyways they had placed as a condition of my husband's parole that he have no contact with me, his wife. I have recently filed in the Federal Courts, Northern District of California a motion for a temporary restraining order, restraining the parole agents et al from enforcing this condition of parole because I feel it is in violation of our constitutional rights. From what I believe the judge will be issuing a restraining order against them this coming Tuesday. I filed a Title 42 Section 1983 lawsuit against them.
