Vickers executed after second trip to death house


Condemned prisoner Billy Frank Vickers, 58, who has a history of
convictions and prison terms, was executed today for the slaying of a
Lamar County grocery store owner during a botched robbery almost 11 years
ago.

Vickers spent 10 hours in a small cell just outside the death chamber Dec.
9 while the courts considered an appeal challenging the constitutionality
of the drug combination used in executions.

When the 5th U.S. Circuit Court of Appeals could not resolve the case by
midnight, six hours after Vickers was scheduled to die, the execution
warrant expired and Vickers was returned to death row.

It was the 1st time since Texas resumed carrying out capital punishment in
1982 that a condemned inmate's death warrant expired without a resolution.

The following day, inmate Kevin Lee Zimmerman won a court-ordered reprieve
in the same appeal. But the reprieve was lifted less than a week later
when the U.S. Supreme Court rejected the appeal, clearing the way for new
execution dates for Zimmerman and Vickers.

Zimmerman was put to death last week for a fatal stabbing during a robbery
in Beaumont. The contention that the drug combination resulted in cruel
and unusual punishment was raised again in his case, but it failed on a
Supreme Court vote.

The drug issue was included in new appeals pending in Vickers' case.

Vickers was convicted of killing grocery store owner Phillip Kinslow.
Vickers and 2 accomplices weren't aware Kinslow had a gun when Vickers
tried to rob him in 1993 near Arthur City, just south of the Red River.
Vickers was shot 3 times, and Kinslow was fatally shot.

Vickers becomes the 4th condemned inmate to be put to death this year in
Texas and the 317th overall since the state resumed capital punishment on
December 7, 1982. At least 10 others are on the execution schedule for
2004, including 4 in February.

Vickers becomes the 78th condemned inmate to be put to death during the
tenure of Rick Perry as Governor of Texas, all since 2001.

Vickers becomes the 8th condemned inmate to be put to death this year in
the USA and the 893rd overall since America resumed executions on January
17, 1977.

that is awful.I can't believe people believe in the death penalty.I am aware that a lot of the crimes commited were/are "heinous" and deserve punishing,but it is not our place to decide if man lives or dies.IT IS CRUEL AND UNUSUAL PUNISHMENT and what if a man is innocent?People make horrible unrepairable mistakes,I do know this,but people also change a lot of times w/ so much time to think,and I just do not believe that everyone who might have done such things is of no more use to any one else in society because of this.Sometimes they learn and try to help others.It costa more for a capitol trial than it does tio incarcarate an inmate for life term in prison.

Evertime another person is killed by the state I wonder when it will all end. I still can't believ this is going on in this day and age. When will America grow up???

Hi everyone-
I don't know if it is just the fact that I am paying attention more to the death penalty being in the news or if it is in the news more lately. But what I wanted to say was this is definitely an important year to vote. I think if we get the right Democratic candidate against Bush, there is a good chance Bush won't be reelected. This is my personal opinion, I don't want to offend anyone. And if there is a president that opposes the DP, we may see a national moratorium. Wouldn't that be lovely! I think that even though the majority still favor capital punishment, all the issues that have been going on surrounding the DP are drawing people's attention to the fact that there are some major flaws in the justice system. And education in the matter of capital punishment is what is so desperately needed for people to see that murder whether by an individual or by the state is wrong.

I have been studying the death penalty a lot lately and the problem is that so many people believe in it. If you read comments from people after they hear about a murder and all the really bad things they say about them it's really scary. I firmly believe that (and it is sad to say) that there are a lot of people in Texas who really believe that the death penalty is good thing. When is it ever going to stop. No person, not even the one with the highest degree can say for certain that people cannot be re-habilitated and be remorseful for what they have done. Is it just their biased opinion or do they say what people want them to say.

I may live in a third world country (South Africa) as we are refferred to, but at least we don't kill those that make mistakes.

May Mr. Vickers rest in peace, and my the State of Texas learn a lesson from a third world dweller - don't kill what you create.

You are sooo right so right so right!!!!!!!!!!And perfect quote just perfect!!!!!!Unfortunately,I CAN'T vote,but if I could I WOULD I hope that other people will vote for me or in my place????
