Man's probation violation after 13th DUI brings jail time

JACKSON - A Jackson man with 12 convictions for drunken driving has pleaded guilty to violating terms of his probation after being arrested in June on his 13th DUI charge.

Randy M. Harper, 48, pleaded guilty Friday and will spend the next year in jail.

His probation on a 1999 DUI conviction was revoked Friday by Hinds County Circuit Judge Winston Kidd.

Kidd also ordered Harper to undergo mandatory alcohol and drug treatment and placed him on two years of probation after completing his sentence.

Harper still faces the June charges by the Hinds County Sheriff Department of DUI, careless driving, not wearing a seat belt and driving without insurance. Department officials said they are considering Harper a habitual offender if he is convicted of the latest charge.

In 1999, then-Circuit Judge James Graves Jr. sentenced Harper to two years in prison and placed him on two years of probation at the completion of his sentence.

State law mandates a felony charge on a third DUI if a person has been convicted or pleaded guilty to two previous DUI charges within five years.

If convicted on a felony DUI conviction as a habitual offender, Harper faces a maximum punishment of five years in prison and a $5,000 fine.

A Hinds County deputy arrested Harper on June 29 and charged him with DUI after he saw him driving erratically. Harper refused an intoxilyzer test.

He admitted on Friday to each of the allegations.

The maximum amount of jail time Harper served on any of the previous charges was 30 days. He paid fines of $800-$1,000 on most of the charges.

My husband was on probation for his 3rd dui. The reason he went to prison was because he violated probation by being in another county and for not reporting for 3 months to his probation officer. ANyways he got sentence 4 years. Now I am wondering how did this guy who has 13 dui's get no prison time? He must know some people in high places.
