I'm so confused.My son, Allen was sent from the regional jail to Indian Creek 12/19/03. He saw medical and the psychologist while there. Out of the blue he was sent to Sussex I 1/15/04. He was in 23 hr lockdown for serveral days. Finally, 1/20/04 he spoke to a psychologist at Sussex and they had a record with his name and number, but had him listed as a black male in for heroin distribution and a 4 yr sentence. Well, Allen is a 6 ft 4 in redheaded, freckled faced fellow with a 20 yr sentence. He tried to explain that his record was not correct and he was accused of lying. Today, 1/23/04 he finally met with a counselor for the first time since he's been in jail and prison and he explained the error in his record. She says she will look into things. That he shouldn't even be at Sussex I because he hasn't even been classified. Don't they tell you or give you an update sheet or something?

i believe after they give some kind of sheet.i'm not sure when that is though.goodluck.sorry i really couldn't be of any help.maybe the legal forum could help you.

Update: Allen saw the counselor today. She said they had misclassified him at Indian Creek as a level 5. They had not used the formula correctly. He is really a level 3 and security level 1. He is in for pending transfer, but it may take a couple of months due to overcrowding. Also, he has yet to recieve anything in writing stating his classification, he has requested this. And the part about him being a black male and the wrong charges and time, that error was made at Sussex I. This is so scary, how many other inmates has something like this happened to.
