My fiance is waiting in Harris County right now for his hearing. He'll have been there 5 weeks by the time his hearing comes. He said due to the over crowding in Harris County, the days there count as 2 for 1. Does anyone know if this is true, or just rumors? Also, if he is sentenced more time, it will most likely be in a state jail. IF the 2-for-1 in Harris County is true, will that time he spent in harris county, still count as 2 for 1, or will it just be day for day, since his state jail time will be day for day?

Sorry you've not gotten a reply yet!

I'll try to answer best I can. I have a friend whose husband recently left Harris County for state jail. He was sentenced to six months. As part of his sentencing the judge gave him credit for his county time and he is now serving three months in state jail. No two for one there - but that is one instance. Now, as best I understand it had he gone to a TDC unit he would've received two for one credit.

I know the rumors are absolutely running like crazy through the county jail. Every one that my son questioned turned out to be just that - a rumor.

Hope this helped some.

Thank you Mamajmg, you always come to my rescue :)
His hearing is this Thursday, and I'm worried sick. I know state jail is day for day, no early release/parole, etc... but that gives me hope that maybe his county time can possibly count as 2 for 1 still. he almost has 3 months accrued if they count the county time as 2 for 1. That gives me some hope that at least it's not unheard of, for county time to still count as 2 for 1. Thank you again, so much. I really do appreciate it :)
