My fiance is in Florida DOC and the senate is propsosing a new bill to reduce time served from 85% to 65% for non-violent offenders. He is in for a drug charge, but also for resisting officer with violence. Would he be considered a violent offender??? I hope not!!! Thanks for your help! :cuffs:

Hi... sorry you hadn't had any replies yet, but - especially since we who have loved ones in for violent offenses are probably the minority on PTO, there aren't a whole lot of us compared to those with non-violent offenses - members don't necessarily log in every day and there could be responses to your post for weeks to come.
Anyway, all states have different rules and regulations when it comes to classifying violent offenses so what's true in one state is not necessarily true in another, however, over time and discussion we've found the majority of them are about the same - if another person/"victim" is involved who was or could have been hurt and felt fear of any sort, than a crime can usually be labeled a violent offense.
Unfortunately, I would guess if your fiance's charge officially reads "resisting officer with violence" or says anything about violence in it then he is probably considered a violent offender in that state. Not absolutely positive, of course, since I am not really familiar with the laws in Florida but I would guess if the charge read "with violence" than it would be considered a violent case.

Thank you for posting back Lys, I was scared that the answer would be yes! I am definitely going to look into this during the week and call some numbers at Tallahassee, I know they have one for "victims of crimes", maybe they can shed some light for me in Florida. Thanks again!
