Then they go every three months. love-austin 05-17-2004, 10:00 AM How do you know if your loved one is elegible for the emergency powers act? aj1978 05-17-2004, 04:58 PM love-austin, this is what the emergency powers act said about who is elegible for it: "When the board declares a prison overcrowding state of emergency due to exceeding ninety-eight percent (98%) of the rated capacity and notifies the Director of the Department of Correction of the emergency as authorized, the director shall certify to the board a list of those inmates who are Class I and Class II, and the director shall indicate which inmates he recommends. The listed inmates shall be those who, if authorized, would have their parole eligibility, transfer eligibility, or minimum release dates moved up to a point where they would immediately be eligible for parole, transfer, or discharge." I thought it was 3 months, but my fiance has told me that now it's up to a year. aj1978 05-17-2004, 08:31 PM I'm not sure how close to their p.e./t.e. date they have to be, I didn't see anything about that mentioned on the page that I got my information from, you can go to http://www.arkleg.state.ar.us/ftproot/bills/2003/public/SB720.pdf and read it if you want, I might have missed it. All it said was they have to be a class I or II to be eligible for it.
