Well,this is the first time i've wandered into this forum and just wanted to tell everyone bout why... My fiance is 19 yrs old,and has a sentencing hearing on January 22,2004 (day after his 20th b-day)...he has 11 felonies against him for burglary..and he was offered a plea for 5-15yrs..but he wouldn't give them an answer until he got to talk to me and asked me what I wanted him to do..i told him what i thought and that i didn't want him to do what i wanted, but to just consider what i said along with what he thinks...so he decided to decline the plea and take it to trial..so the 22 is a trial/sentencing or however it works. He could possibly get more,or possibly get less.. i guess we wont know till the 22. But those charges are just for one county..he still has 2 more counties and NY State to go...:( i have a feeling he'll be away for a LONG time..i miss him so much already! A friend i talk to on yahoo told me that if he gets 5-15yrs he could get parole after 2 yrs..is that true? If he's a 'good boy' could he get parole after only 2 years?! Well just wanted to let you guy's know bout me and my boo and ask a few lil questions...

i don't know the answer to your question. But i know how you feel. At first with my sweetheart they were saying 32 years!!! I was devastated.. The they offered a plea, and with extradinary circumstances and if they aggravated it it could have been 16 years!!! Finally with the plea, normal sentencing was 2-4 years, and with extradinary circumstances (he was on parole when this all occured) it could have been 2-8 years. The waiting and worrying was endless, and tiresome. Try not to worry its a waste of energy and it will pull you down. Thank goodness my sweetie only got 3 years. Still a long time, but thank goodness not 32!!!!!!!! **********{HUGZ}}}}}}

Good luck on the 22nd! My husband got the "bitch" (habitual) charge and he recieved the least possible for his crime-48 years. The charges held a 6-12, but we all know how that can go...the appeal judges looked at his case on the 6th so now we just sit, pray and wait....my prayers are with you! It's always safe to expect the worst but hope for the best.

The laws of each state will be different. My fiancee is in Georgia, her public defender persuaded her to take a plea agreement, he told her she would only serve 5 of the 15 years and would get parole. She is now serving the 11th year of her sentance. She has done all they required, has had no DR's, yet they will not give her parole. I have had very little success with a lawyer filing a habeas to re-open the case. They have all told me that if she had been found guilty, it would be easier to do something. It seems that in Georgia when you sign the plea agreement you pretty much sign your life away. You need to research what the parole board is doing in your state with those type of crimes. If you believe in God, it's a good time to seek His guidance.

hello everyone .i'm mary from texas . my husband is in coffield prison in tennesse colony, texas. he has been there since 1992. he got 35 years aggravated. his lawyer sain he would only do 1/3 of his time will we are at 1/3 and no parole yet. he saw parole board in dec.2003. no answer yet. i hopr and pray hr get's out i've wait a very long time too hold him. say a pray for us.

Well to update everyone on this subject..well Matthew didn't take the plea,and didn't go to trial..he just got sentenced..i dunno how the court thing works but no trial,no plea...he got 30-96months..that was in addition to the 3-23 months he got from the first sentencing that happened that morning...so for Erie County..he got a total of 30-96 months.. In Warren County, we're gonna see what his P.D can get for a plea,and decide after that whether to take it to trial or not.. I'll be without him for atleast 2 1/2 years..still have 3 more counties to go threw..:( i miss him..still...
