View Full Version : Got scared at Restraining Order Hearing and Left, Can I file again?

I filed a restraining order against my soon to be ex-husband. I got a TRO and then got a hearing. I got really scared at the hearing, he had a lawyer and I just freaked out and got scared. They dropped my TRO because I left. Can I refile or is that not allowed? I am hiring a lawyer so I don't get scared. I know it sounds stupid but I just got super scared and darted out of the court room. I'm so mad at myself. :(

You can also go to your local domestic abuse agency - they may have some extra help for you, even someone to just hold your hand through the hearing.

I would think you could refile for one, get someone to go with you this next time. someone from the Victims assistance office can go with you, they can arrange to meet you in the parking lot and escourt you to the court room and back to your car. I am having someone drive with me to and from the court house as well, a police officer. I was told I could get a police escort as well. Dont be mad at yourself, your not the first person who got scared and ran and you wont be the last! Pat yourself on the back for not falling prey to him once again after seeing him! You did great, just got scared, it happens. Refile and get your restraining order!

I would have done the same thing if I did not have an advocate from our domestic violence help center with me. They stayed with me the whole time and even went up in front of the judge with me. I am sure they have one in your county...just look them up. I did not need an attorney just my advocate, but what ever makes you feel comfortable.
