Does anyone know where I can info on filing bankruptcy under the poor man's act?
My fiance is looking to file before she gets out, so that there is nothing for the parole to hold over her head when she gets out (hopefully next Nov.)

There is no such thing as a "poor man's act" under the bankruptcy code. She would file her bankruptcy petition as any other debtor would, with the ability to pay the filing fee in installments. I would suggest you hire a bankruptcy attorney for her and let a professional handle it. Should run her about $1500 total. Any criminal restitution/fines, taxes, student loans and unpaid child support must be paid in full and cannot be discharged.

i have power of attorney for my fiance' and found a attorney that charged me $680 to do his. i know you can purchase a book at barnes & noble and do it yourself, as long as it's a simple bankruptcy. the book costs about $35 and i know the filing fees here in michigan are either $100 or $200 (the old age is getting to me) so i'm not sure which, you can also pay it in installments.

I was thinking where I heard of 'poor man's act' before. I think if documentation is needed, like birth certificate or something, then forms can be filed under that 'act' and the normal fee for such certified documents will be waived. As others have noted, far as I can remember, it wasn't anything to do with bankruptcy.
