about a year ago me and my babys father (baby 4months now)got into it and i got so mad at him and i did hit him .He restrainned me from hitting him but he didnt do anything to me hurtful.When the police came i was so vindictive and upset that i said he did hit me and i know it was the dumbest selfish thing i couldve done:o.I feel so dumb and stupid because real women get abused everyday.Now he has to do 7 years (found out monday 1/26/09) and i want tobe able to visit him and marry him but im not sure how to get around this pending case

Sorry, Sweetheart, but in California, you're going to pay dearly for your folly.
I suspect there may be more to your story, or his history, than you're telling us because a first offense with a recanting victim rarely draws a sentence like that but no matter-
If you and he both petition the courts to amend any "no contact" orders, agree to AND complete counselling and anger management, you might be allowed to visit and he might be allowed contact with you after he's released.
He'll never be allowed family (overnight) visits due to the nature of his conviction, even if you are by some miracle approved for marriage.
You CAN allow someone else to take your son for visits- They'll need to be approved visitors and will need the baby's birth certificate and a notarized letter from you giving consent for that person to take that child to that facility to visit that inmate during that timeframe.

Am I reading this incorrectly? How do you have a sentence on a case that's still "pending".
I agree with the others, we're missing a huge chunk of this story.
