Hello all, been a while since I've been here.
My question is, can a 16 year old girl get a restraining order against her abusive step dad even though her mother won't get one?
If possabile i need this answered ASP.

Assuming that it is her (the 16 year old) getting abused, then yes, she can seek the help of the courts.....If she's prepared to file a criminal complaint and possibly get placed in the foster system.

It would be virtually impossible to get a restraining order against him without the criminal complaint, which would probably also involve charges of neglect/failure to protect against the mother.

It's also marginally possible that she can file to become an emancipated minor. She'd need to check in with a lawyer to find more about that. What kind of abuse?
