how can we get the marriage license when both parties have to apply for it together. the prison he is at now refuses our wedding request because both have to be there to get the license:confused:

In NC, some counties give a waiver for the inmate to sign and have notarized stating that he cannot be present to apply for the marriage license. Call around to some register of deeds and ask them how they handle prison weddings. Good luck.

In Texas if you want to get a marriage licence then you have to have marriage papers by proxy. Then you both decide who you want to stand in his place. Then you AND the stand in have to go together with both your ID's and the paper from the inmate stating the one you have chosen to stand in. Then you have to wait 3 days but no more than 30 days to have your vows done WITH THE STAND IN. You can do that with the justice of the peace or a pastor if they are willing to do it for you. Then you will be legally married. In Texas though, the inmate is NOT allowed to have a copy of any marriage licence. But, that is what you have to do.....

In CA, the inmate's signature is notarized on an inability to appear form. That form allows the bride to go with the minister to purchase the marriage license.

You get the papers from his counsler.

In IN I have to fill in my part of the licence then take the rest of it to him for him to sign (with his councillor as witness) then take that back to the court and they will issue the licence.

We have been trying to get married in pa and have run into the same problem. Both parties have to be present to apply for the marriage liscence. If anyone has any ideas about how to get around this rule in pa. please let me know.

ted got locked up on our wedding day so i still have the old marriage liscence. but i'm not sure what its going to take to a new one since the old one expired. i am so lost....i dont know where to begin and i'm not getting any help from the prison. so if anyone in ohio knows what i gotta do PLEASE HELP :(

In Nevada I had to go to the Marriage Bureau get an Affidavit which the Chaplain has to notorize.

If you call the Chalain at the facility where your fiancee is at he can tell you the procedure.
