SO, my sister and her BF got into an argument and a neighbor called the cops. They took him away and charged him with DV. SHe did not get hurt, or threatened. It was only an argument. He is in jail, and can't see her. She is freaking out because she wants to see him...she is also 8 wks PG. Does anyone know what she can do so that she can see him or at least talk to him? Just to ease her mind...she's worried that he will leave her after this..I just need her to chill, I can't take the stress. Where does she call to get this order lifted? We are in Michigan

i myself went through the same thing neighbors called the cops he ended up with 9 years. But because in your case there was no injury 3 out 4 times the da will drop the charges. they have nothing to go by. he has to be seen in court within 72 hours if he has not the case is on o.r. or again the case is dropped if not his first court date let his public pretender know that she wishes to have contact with him hope it helps.

If there's no history there, then it's possible the DA will simply not prosecute. If there's any violence or criminality in his history then it's a bit more of a crap shoot.

In some states if the police are called for a domestic violence complaint an arrest HAS to be made. The reasoning behind this can be good or bad, depending on how you look at it. As others have said the ultimate decision will be up to the D.A. for prosecution, if there were no injuries, and no complaint of violence from your sister her boyfriend should be ok.

Thanks for all of your answers. I guess my sister found out that he pleaded gulity yesterday, and she talked to the prosecuter and is trying to get the PPO lifted. He got 92 days in the CO jail. I'm not sure if he is doing the time right now or what? But she is hoping to see him soon....
