Here is another site from the state public defenders website. It tells how they go about formulating the sentence. Perhaps some of you are at the stage where your loved one has not been sentenced. This may be helpful to you.

I actually challenged the guidelines as I felt the probabtion and parole officer was scoring my son too high and was able to bring down his sentence from 75 months to 30...

I don't understand the guidelines page. Does it mean any felony committed before 99 is not subject to the guidlines? My fiancee has 2 felony's from 96 and one from 98 and then his current one. He has a few misdem. but they said at his sentencing he has a guidline of 25 which is not good I guess but I think it is to high is htere anything we can do. They used his youth record against him to but I have been told recently when he turns 30 next month he can get that exsponged is this true and if so how?

I think, and I may be wrong, as we don't do a lot of criminal work at my law firm, but to have a record expunged, someone has to be trouble free since the crime he is trying to get expunged.

To have an item expunged, you have to be convicted of only one crime that is not punishable by "up to life" and have no additional convictions for five years after completing your sentenced. Ex. If you received 2 years probation, you have to wait 5 years from the time the probation is complete before you can request the item to be expunged. If the maximum penalty was life and you got probation, you still cannot get it expunged. If one incident results in two convictions, you cannot get either expunged.

Isn't a juvinial record different though.. My brother is in Pugsley right now and says he is working on getting his exsponged and my hunny will be 30 next mnth and my bro said we need to do it.

I don't believe there is a difference for juvenile record. I'd try calling a lawyer. I would think they would tell you whether or not it is possible without charging a fee.
