My husband was fighting burglery cases some more serious in Sutter County and more of them in 2 counties, Butte County, and Sutter County, California. He was sentenced in Butte County 1st on 2/15/07 to 2 yrs w/half. He was due to be in Sutter County for Sentencing 3/26/07, his lawyer did not put a hold on him therefore he was taken to prison early March 07. He filed a 1381 to be taken back to Sutter County for sentencing. Of course he got a Failure to Appear because he was a no show on 3/26/07 duh he was in prison, they dont talk to each other evidentally. anyway came back to Sutter County 7/07 until 10/07 when he was sentenced in Sutter County to 6 yrs 4 months. Thats 3 years on the controlling case and several consecutive 8 month sentences, on each sentence the last statement is sentence will run concurrent with time already being served in the Butte County case. PC2900.5 says that CDC needs to calculate prison credits to allow for this time, but other information i get says the 7 months prison should have been on the Abstract. Forget getting any help from our lawyer, he is done with us and we have no money for another for an appeal if necessary so we are hoping that CDC will calculate the 7 months because he was in custody of the CDC. So with that does anyone have any advise on where to go and who to talk to about somebody to count that 7 months, because as i see it, but i am one sided :eek: is that concurrent with the Butte County case he had already done 7 months on that case and it didnt say concurrent from Sutter County Sentencing date. Is there something i am missing or did they just screw us over and nobody is counting time he has already done on the same type of case and was incarcerated on. This would bring my man home June 09 instead of 1/10, and i hope someone can fix this or help me. Thank you guys, all of you always have so much information.

Concurrent means the cases are being served at the same time, not that they started at the same time. CDCR will make the Sutter County case the controlling case because it keeps him in prison the longest. The start date for the Sutter case will be the date he was sentenced. The Butte County case will become the non controlling case because it will end before he gets out of prison. The time served on the Butte County case prior to being sentenced on the Sutter County cases will only apply to the Butte County case and not to the Sutter County cases.
