View Full Version : Beforehand?? - Appeal before they move him? Where are they sending him?
Amelia 03-24-2002, 01:37 AM I was just wondering..Stephen has already been sentenced but his attorney has filed for an appeal..will they send him "up" during this waiting period ( he also has pending charges in a neighboring county) and if so can I find out beforehand when and where he is going? Any info would be appreciated greatly!
soraya 03-25-2002, 02:26 AM I was told, if you have the DOC number, you can search on www.bop.gov and you should see the next prison he'll be transferred to. not sure if this is always correct though

sherri13 03-25-2002, 05:01 PM I don't think they left you know beforehand and it is not listed on DOC page because of security reasons (transporting, escape attempts,etc) I do think they post it the dayafter he is transferred though so i would just check daily online

While he is in diagnosgtics visits are usually not allowed because they are there such a short time. He will then be transfered to a unit or what we call a prison. There is no way to find out before hand where he will go just call huntsville and stay on there butts. There # is 1-800-535-0283 or 936-437-6371. You can get all his info from them as soon as they enter it into the computer.
The ladies there try to be as helpful as they can. Also you will need to send any money to him via the Inmate trust fund and he will have to send you some money slips. Without them they will not process any money for him. They also require that it be a postal money order only, every thing else will be rejected.
IF you need to know anything else just let me know ok

I havent heard from Stephen today so that always gets me nervous but how long are they in diagnostics? thanks for the numbers...Will the money he has on his books now follow him? Thanks again! Shortie 03-25-2002, 10:00 PM He can be there for as little as 2 days and as much as 2 months most of the time they are out of there in a week or so. Anthony always gets out really quick.... Like 4 or 5 days. It just depends on there crime and where there are going to put him. When he gets done there they will transport him to the unit.
Yes the money he has on his books will follow him there. If he has any personal property I would have him release it to you now. Sometimes it comes up missing in the move. IF you know what I mean.

Your loved one will begin his sentence pending his appeal unless he has the money to post an appeal bond, in most jurisdictions, depending on the amount of setnce.
You should be able to learn of the charges pending in the other county. If you are unsucessful, his attorney can discover them.

Any idea on what an appeal bond will be for 2 two year sentences to run concurrent..i would like to start planning just in case..also I am checking out your site! I can not answer your question with certainty. Each state has its way of appellate procedure. However, if I understand this matter correctly, he has two (2) senrences to be concurrently served. It is not unusual for an appeal bond to be set at a thousand ($1,000.00) for potential year of conviction. It may be possible for the circuit court to set bond at two thousand ($2,000.00). He could be bailed pending appeal.
Please understand, I have no way to know what the court might do, or what the court may set the appeal bond, if at all.
This will require an attorney's attention; this not a simple request for bond.

Amelia 03-26-2002, 10:03 PM Thank you so much for your advice and info..I have my attorney wotking on it but I like to know a little myself too-make sure he isnt BSing me...He has mentioned an apeals bond so thanks!!! Also do you knwo how long on AVERAGE it takes to get an appeal? or have your request heard? He says it just takes time but my husband is getting a little antsy??? :D
