View Full Version : Moved from state back to county - what happens to the pending 115 at Wasco?
coffeegirl 08-11-2008, 06:47 PM a 115 was filed 2 weeks ago on my fiance, and he has been moved to county, the case here has been postponed for another week and i was told that there is ony 30 days to hear the case in wasco. any information on that or where i could look it up?
Butrfly420 08-12-2008, 09:14 AM Do you remember who his counselor was at Wasco? If you can...I would call that person and ask what is going to happen since he is no longer at the facility. I know he has 30 days to go to his hearing for his 115...so I would assume that they would transfer him back to Wasco for that. But that is what I would try and do. Keep us posted sweetie. :)

well, he more than likely will be here for another two weeks to settle his case. so what would happen? would they have to drop it or postponne it?
aliferzwife 08-12-2008, 10:32 AM It's hard to say for sure. They could just re-start the clock when he returns or drop the whole thing, depending on the seriousness of the disciplinary action.
I think it is good advice to try calling his old counselor. Good luck - let's hope they just drop the whole thing. :)
coffeegirl 08-21-2008, 09:18 PM well, my fiance is still in county he was given his 115 on August 1, and he has his next court appearance on August 28. I got on j-pay and looked him up and he is no longer in the system. i am probably wishfully thinking, but shouldn't he have been notified by now about the status of his 115 if they are going to push it? he will be here still for at least another two weeks which i think exceeds the 30 business day limit. and i also read that he is supposed to be notified of something within 15 days of the write up. i have read so much about it i can't remember now what everything said. but it also said that the case could be transferred to where he is and he is going to try to finish his time out here in county to pay off his fines. any suggestions i know i am rambling, but like most everyone else, not knowing is driving me crazy. i haven't called his counselor yet, i am procrastinating on that one. but i also got all the mail i had sent him right before he left sent back to me today. i am probably just wishful thinking that this will just go away, i just want to start a count down, but i can't yet. the county is wanting to give him a year for the dui, plus probation. he is supposed to be off of parole on jan 22, can you be on parole and probabtion at the same time, or maybe it is informal. but i know the jail time will run concurrent with his prison time and time served. but his pd said he could probably fight it down to a wet wreckless. somebody give me some advice, or just slap me and tell me to be patient.;)
Butrfly420 08-21-2008, 10:45 PM I am not exactly sure how everything is going to work with his DUI...but I remember someone saying that there was a chance that the prison may not do anything about the 115...it is really up to them on how they want to handle it. I would really encourage you to call his previous counselor at Wasco. That might help shed some light on what will happen...at least from the prison end. That way you can prepare yourself either way.
I hope they dont worry about the 115....but I would call just to be sure. :)

braceface07 08-22-2008, 10:59 AM just to give you an answer, yes someone can be on parole & probation. I hear ya about not calling them because you might stir something up, sometimes it pays to be quiet.
Once the inmate leaves CDCR custody, the time frames for the 115 process are suspended until he is back in their custody. The 115s are placed in a suspense file and brought out when he returns. When he gets back, they will pick up the process where they left off. It happens frequently.

what if he finishes his time out in county to serve his time for his fines? will they transfer him out to wasco automatically? Does he have to go back to wasco no matter what? this is very discouraging being that he was not involved. now he will have to file an appeal if he goes back and that takes alot of time too. so i guess he won't be home oct 5.:(
Once his court proceeding are complete, he will return to Wasco to complete his sentence. Any time given by the courts for his fines will probably be concurrent to his state sentence and be served in CDCR until his CDCR release date.
coffeegirl 08-23-2008, 12:15 PM his attorney said that he would probably be able to finish his sentence off at county because of the fines. so, is that not a possibilty? and if he were to be found guilty of the 115, how long does an appeal work? he already has a 602 form. and is there such thing as an emergency restoration of credits? it is just the guards word against his, and he has witnesses that know he was in bed when it happened. he also had already talked to an investigator before he was trasferred. thank you for answering my questions.
