View Full Version : White collar; Embezzlement; safety

Hello, I am facing two counts of embezzlement which carries a 10 year term + fine.

I am married with two children under the age of 10 and am holding a steady job in accounting (no money handled). I plan on pleading guilty and praying for a lenient judge and many letters of support at sentencing.

If I do get a prison time, what are the chances of me going to Parchman? If my sentence is less than a year is it likely that I could stay at my local count jail for the convenience of my family?

Also, being that this is a white collar crime and I am, or was, a professional in the business world I'm concerned about my safety in a state prison. I'm an average size guy and could never hold my own if 'chosen'.

Praying for the best outcome for my family....

This was my charge. I was sentenced to 5 years, with all 5 years suspended, and 5 years probation.

Most cases are given probation first time. It is unlikely you can serve your time in the county jail. Where you will go depends on the classificaiton level you will receive by the DOC.

Thanks for the fast reply Jonathan!

Unfortunately, I plead out to a felony false pretense 15 years ago that was non-adjudicated but never expunged due to a 'lazy' attorney that I never followed up with. My fault and now it may come back to haunt me.

Not sure what to expect on a sentence at this point. My arraignment is soon at which time I'll get a trial date. I hope the trial date is far enough out that I can have some time to negotiate with the DA and prepare my young kids and family. I've got a great attorney who is well liked and highly recommended on the Coast.

Reading some of the messages here I guess if I have to go to a state facility that Stone County may be the closest and best for me since I'm in Harrison County.

Why did you go to CMCF if you got 5 suspended?

That depends on how well the local sherriff likes you. But you would have an excellent chance of avoiding Parchman (although a lesser chance of avoiding CMCF.)
