Hi CA - I am writing from AZ. I have two specific CA legal questions if anyone could help me - even though I'm here in AZ I would greatly appreciate it.
1. can anyone talk to me about interstate compact transfers? My man got extradited to CA but we live in AZ and he needs to come home to me when they let him out - whenever that is - he hasn't gotten sentenced yet.
2. has anyone had the expierence of working with a lawyer who blatantly says "i don't have to like him." ? Does this mean she won't do a good job for him?

Did your man engage in criminal activity in CA?
Who cares if the lawyer likes him or not..............so long as whe does her job and does her job well, then nothing else should matter.

I'm sorry I can't answer your question, but there is this member who is an ADA in Georgia that seems to know alot about the law, etc. and has answered a ton of questions. Maybe you can Private Message him? just a suggestion........OR maybe someone else will come around who can assist. If not, here is the link to "YourFriendlyDA". Hope you get the answers you need.

are really confusing me - as to how to respond to each post personally - but here we go!
his original crime 2 years ago was in CA. He did his time and bounced. -Which he should not have done. They extradited him back to CA - so he is facing sentencing for his second probation violation - and he was gone for about a year....
as far as if she likes him or not - i agree - i don't CARE if she doesn't - I just want her to do her job - and i worry that her personal feelings might get in the way. I hope/believe her to be a professional - but it makes me nervous all the same.

If you want to reply to people on an individual basis, it may be easier to PM them instead of posting to a forum. You can also respond to each person in a forum by hitting "quote" and the person that you are responding to will be easier understood because you have "quoted" their words within your reply.
Makes sense now as to why he was returned to California. I believe (and I could be wrong and so you may want to aks the lawyer who doesn't like her client) that a person will parole to the County in which they resided prior to being locked up.................or they can parole (with permission) to a place (home of family member or spouse) who is willing to allow this person to parole to their home. Again, I am giving you an uneducated reply and so my reply may not be 100% valid. There might be a forum within PTO for legal advice and if not, you can always google your question.
Regarding the lawyer who doesn't have to like her client but has to do her job the right way without letting her opinion getting in the way...........
Ask her how she plans on doing so. Ask her what methods she uses for the purpose of giving something her all......................when she can't stand the person in which she has to give her all for.l Ask her to give you examples of cases (without breeching confidnece) in which she couldn't stand her client, but she actually "won" her case based on her skills and ability to rermain professional.
If you still are not comfertable, retain someone else.

There is a section at the beginning of PTO called the resource center and one of the forums is entitled legal help. Perhaps you can get some help there. Best of luck to you.
California is sending a lot of "qualified" orisoners to a few different facilities in AZ, called "out of state transfers". He can put in a request for that, or he can also put in a request for an interstate transfer, where he would be serving his time in AZ. There's a CA forum for the out of state trasfers that initially started on a voluntary basis, and because of our vast overcrowding is now being done even involuntarily. But it may be just the thing for you. He would still be considered a California prisoner but would be housed in AZ. Check out this link for a little more info:

Good luck. And I would find a different attorney, myself. Life has enough headaches to add an arrogant attorney to the list.

you all have been so very helpful -
how will your advise be different if he is in jail and not prison? His PO wants to send him to prison - but currently he is awaiting sentencing in Jail - and we are hoping for a 6 months JAIL sentence - in which we can begin working on the interstate transfer papers for his probation.
thoughts?

I did PM him and he has most definitely helped!! Thank you so much for helping!
I can tell you my experience with abscounding. A old boyfriend of mine left CA while on parole and came here to NY to live with me. He was gone for about 4 years or so and went back to CA and was picked up on the violation. He was sent back to prison and was given 9 months for the violation. He served 50% of that and was out in 4 and a half months. That was about two years ago.
