My husband is in California in prison, he only has a year or so left. I am in Washington where my family is. My husband has been in and out of prison his entire life, he's done and tired, not wanting to be there or in that life anymore. Unfortunatly since he has spent so much time in prison other prisoners do recognize him, he nor do I like this. Do you think it would be possible to get him transfered to Washington State? Where would I start my research?? :confused: Is it a slippery slope requesting a transfer? What I mean is if he did request a transer to Washington could he instead be transfered somewhere else?

Has he tried talking to his counselor about transfering out of state? When my husband was thinking about it...he talked to his counselor and was told that he would need to fill out some paper work to transfer. I dont know if they give them to option to say what state they want to go to. I would definitely encourage him to talk to his counselor though :)

I don't know the answer to this for sure, but it seems to me that if he is willing to transfer out of state, then it follows that CDCr would want to get him else where since they are trying so hard to deal with the over crowding.
Perhaps you can contact the Ombudsman, but defiantly have him start with his counselor.

I don't think they will allow him to transfer to a prison in another state, the prisons that guys are getting transferred to are all under contract with CDCR. He can put to transfer his parole to another state though, providing he has family there.

Here is some information on out of state transfers from the Department Operations Manual (the DOM). Check out the information starting on page 508 of the DOM at this link. It will be page 49 on the toolbar because each chapter is separate and this is chapter 6. He should talk to his counselor.

62040.3 Criteria
Compact resources shall not be used when the inmate's needs can be met
within departmental facilities just as well as in out-of-state facilities.
Inmates whose special or unusual needs can be better met in the facilities of
another state may include, but are not limited to, the following:
• Protective custody. When an out-of-state placement will resolve the
specific cause or reason for the inmate's protective custody within the
Department; i.e., protection of an inmate witness or informant.
• When an inmate's permanent residence, resources and plan for release
are outside California, placement in another state may be considered.
• Departmental policy precludes out-of-state placement criteria for
inmates who are likely to present management problems. Examples of
such cases may include homosexual behavior, chronic gambling,
exploitation of other inmates and gang involvement
