I do not know if anyone can help me with this but I will ask anyway. My guys son was made a ward of the court about three months ago. Before they did that they tried to find a family member that would take him but where not able to do that. He was placed in a group home but was taken out after about a month and a half later for getting into some trouble and violating his probation. He has been in juvenile detention since the begining of May. They are now looking for another group home for him. Well his son has kept in contact with me by letters and phone calls and the other day he asked me if he can come to NY to live with me. I am more than willing to have him here that is not a problem. What I need some advice on is how I go about doing that. Seeing as that he is a juvenile I can not get much information. I do have Power of Attorney from the father to be able to discuss this case with who ever is willing to talk to me. I do know that he has a court date on July 7th and I am wondering if I should fly out to CA and try to attend it. If anyone has any advise I would love to hear it I am at a lose as to what to do. Oh yea the father is totally on board with me bringing the son to NY and he is going to write the mother and try to get her on board with it also.

Hi Shaa,
Being that you have power of attorney from his dad, maybe it would be a good idea to fly out to his court appearance on the 7th. Maybe someone there could tell you what steps to take to obtain legal guardianship. Hopefully his mother will be on board to allow you to take him home with you. I think in the end the courts will decide what's best for him and they will also consider what he would like to do. I hope it works out for you:)

The PO is the one that writes up their recommendation and 9 times out of 10 the judge goes with the PO's rec. So I would definitely get in touch with the PO asap because a lot has to happen here. The need to find out if your and your home are fit for the child. They also need to get his probation transferred to the county that you reside in. Most likely what they will do is sustain the charges in the county he is currently in and then transfer the case out to the county you live in that way all the court stuff is done. It is very hard especially after he's made a ward of the court. Good luck!:thumbsup:

TY no we are not married yet. We were going to do it when he gets out in three months. I have tried calling the PO a bunch of times, I have even faxed him over the Power of Attorney that I have from the father but he has not returned any of my calls. Yesterday I e-mailed the supervisor but that person has not gotten back to me either. I know that the child/teen has told the PO that he would like to come here to live and he has also told his counselor the same thing. I think my next step might be writing a letter to the Judge. I am trying to take all the step that I need to and I am more than willing to go thru the checks and jump thru any hoop they give me but the least they can do is return my calls, faxes, and e-mails. They are just as bad as the CDC.

One more thing, I wouldn't want you to fly out to CA for nothing....if you are the childs parent or legal guardian then you will not be allowed into the courtroom for his hearing (due to confidential reason because he's a minor).
If you've tried contacting the SPO (supervising probation officer) of the PO then try calling and asking for "the officer of the day." If that is no help then your next step is contacting the Probation Manager. Again, you want to follow the chain of command, PO --> Officer of the day --> SPO --> Probation Manager. I got a e-mail from the SPO yesterday saying that they can not confirm or deney anything and that I should try going for guardianship. I have been doing some research on the internet and found a site for CA giving ideas on how to go for guardianship. It said if you can not get any help from the probation officer or the social worker (not sure who that is, but did send a fax to the detention center to the counselor but no response yet) to write a letter to the judge explaining your desire. You I wrote letter yesterday and had my sister who is a lawyer here in NY look it over and make any changes she thought it need. She sent it back to my today and I faxed it off to the judge first thing today. He has a court date Monday so I wanted the judge to have it before the court date. I guess I will just sit and wait now and see what happens. My next step after that I guess would be to get in touch with a lawyer out there if I do not hear anything by Monday. It kind of stinks with the holiday weekend cause who knows who is around or not. The child will be calling me on Saturday so I will also let him know what I have done so maybe he can talk to someone in court on Monday about it. Thank you for all your ideas.
