My son received a letter from the Division of Adult Services Legal Processing Department saying that there was an error in his sentencing. They are asking for a certified copy of the minutes and abstract of judgement. It says the low term was supposed to be 16 months for his charge, not two years as it stated on his original sentencing papers. It will take up to 120 days to correct the error, by then he will almost be home.
I wonder if we should send it, or just leave it alone, they might find something that gives him longer time.

He talked to his counselor about this letter, I guess the counselor is expecting some additional paperwork and they go forward from there. I would think that the judge or one of the attorneys (his or DA) would have known that they were giving an illegal sentence term.

He has been at Norco for a month now. He just got out of receptions, I guess they caught it when he was in reception. It was from the Division of Adult Services Legal Processing Department, I guess they review everybodys sentences, he didnt ask anybody to review it, he was surprised to get this in the mail. His sentence was 2 years, the letter says the max he should have gotten was two years. Of course before this is resolved he will already have served a year at 50% and be home anyway. They said it takes 120 days to fix it.
