View Full Version : Question On How To Transfer Out-of-state

Does anyone know how difficult it is to transfer out of Orange County? My man has been caught in the endless loop of in and out of county jail for probation violation twice (he showed up 5 minutes late to his PO, and failed to register in time) and since he has been inside, he has been told that the system will NOT allow him to transfer out of state. I don't live in California, and want him to be transferred to the state I live in because we are planning to get married and start a business here. His PO is a HORRIBLE person, and obviously does not like my fiance. My man has talked to him with his intentions and his desire to process his request to transfer, but his PO is being stubborn and has not filed the paperwork for us. Has anyone had any experience with this kind of a situation? I am so dang FRUSTRATED right now, and was told by my attorney that his PO is required by law to file his request. This is just terrible because I feel like the system is setting him up for failure!! :angry:Thanks to all who respond in advance...

This is the way I would do it - but this is just MY opinion.

First, I would write a letter to his PO. Make it a very nice letter explaining the reasons for requesting a transfer. Make sure you put in there what your plans are for starting a visit, the fact that you are established where you are, etc. Send the letter certified mail, return receipt requested. Then the PO cannot say he did not receive the letter.

Wait 2 weeks. If you haven't received a response, send a 2nd request (you can send the same letter with 2nd Request written on it) again by Certified Mail, return recipt requested.

Wait 2 weeks. If you have not received a response by then, you can show that the PO is not responding to a valid request.

At this point, send a copy of the letter to CDCR Sacramento, to the head of the Parole Department, along with a letter requesting that they act on this. If they do not respond to you - send them a 2nd request - this time with a cc: to a newspaper, a tv station, etc. In this letter, ask them if they are trying to make men on parole fail so they will return to prison.

Follow up with a phone call. Be a thorn in their side. It took me months to finally get someone at CDCR to listen to me - now someone calls me once a week.

Thank you madhatter, that sounds very logical, a very good idea! But, isn't the transfer request supposed to come from him, and not me? I have no qualms whatsoever writing tons of letters, but I've heard that if we (as outsiders) get too involved, the POs on the case can make it unbearable for them, and ultimately make it so hard for them that they systematically return to jail again and again. But if you think that it's ok for the wives, moms and fiancees to write directly to the PO, heck, I'll definitely give it a shot!!

You said he had requested a transfer. The letters to the PO are just backing up his story that he has a place to live, etc. when he gets there.

You need to let your guy know what you are doing and tell him to make sure he does nothing to get violated.

Once you get past the PO, and start writing to CDCR Sac, if you get them involved, it can go either way. If you explain that you are worried about retaliation against your guy, hopefully they will work with you.

I was worried about retaliation against my son when I wrote to CDCR. But things have actually gotten better for him because I did. I guess it's just who you talk to and how they handle it. It's a chance you can take - or just let things go on the way they are.
