Does anyone know how long does it usually take for ins to evaluate your case?

he's in lakeview shock and just started his platoon everyone keeps telling me that he will be deported but hes been incarcerated for about 4months and no one has told him anything about it so how long does it take before they let you know if in fact he will be deported or not

hi, well my brother is incarrserated to and they have a federal detainer against him . you need to call classification to find that out do it for whatever prison system he is in. well if he does have a detainer on him from ins they will not touch him untill after his crimnal sentence and then he will see a judge.
i really don't know to much as i am new to the whole immigration process but will try to help as i need the help also. well good luck with classification and god bless you

thanks for the blessings i wish your brother the same but i called and i have been calling and they never said anything about him having a detainer on him. All they tell me is his graduation date is may 13

well then maybe you have no worries to worry about. because if there is nothing on him they just have not caught it. usally when you go through recption that is when they catch it and sometimes its closer to the end of the sentence. for now i think you are in the clear. good luck and bless you for writing back.

Lady,I'm not sure if you are talking about deportation after arrest or petitioning for residency the latter takes at least 7 for them to come out and investigate now for the first, from my own experience i can tell you that on the day one is due to be released INS will be there to pick them up and be taken to a holding center from there they will be taken to court and will be given the oppertunity to retain an Immigration Lawyer which i 'd advise to do. Becasue once deportation is ordered it can't be reversed it's a legal procceding that can not be appealed overturned or retried it's set pretty much in stone.If these subjects are not what you were talking about My Bad..

Hi everyone I seem to be in the same position my husband has been in prison for almost 4 months and the INS has not gone to evaluate him but I know that they can come at anytime what do I do when they do go and see him and find out he is not a citizen?

Hey I do have the dame problem with my man he is from mexico and here illegally and he was sentenced and no one has ever come out but they did say through the lawyer I heard that he will probably do his time and then be deported so I dont know either I think it's like a guessing game and when do they decide when they should be granted parole or when they complete there sentence because my man is doing 9-30 and I cant believe they are going to wait 30 years and then deport him ??????? will they??????

well my man is only doing a one to three but its true we cant tell just wait until something happens and then take it from there

well they might not get him now but they will eventuallt come looking . but being in jail does set out red flags out to ins i guess it is a matter whether they want to pursue you or not at that time.

When my husband was given his sentence INS was there at the court house as they has a hold on him before he even was sentenced. As he was being processed at the reception center he was interviewd by INS where they now have a detainer on him. His Immigration lawyer has made an agreement that he be deported within 5 years since there is no relief for him. He also informed me that if there is no relief and there is a sentence of more than 5 years they will get deported by then unless their country will not have them back.

a removal (deportation renamed after 96 laws) hearing will only start AFTER serving criminal sentence. and that only happens AFTER they pick you up. they only pick you up AFTER they're aware of your conviction. and, they only know AFTER they reviewed the file or if you ask them to. that only happens AFTER you ask for classification.
if their isn't a detainer already, and if you can pass for a native born U.S. citizen, then you should probably inquire AFTER an immigration official starts speaking with you. otherwise, they can only apprehend you after release AFTER they find you. best wishes & hope a fast reunion with your loved one.
